Prescription Fraud

I was wondering if anyone would know how much time someone could spend for several diffrent charges..My Step-daughters mother is currently incarcerated and has been for 4 months now and she has still not been sentenced, her boyfriend and her were caught together and were caught for the same thing and he has already been sentenced and was charged with Forgery Of Public Record, Certificate, Return Or A (1 count)   and    Obtain Controlled Substance By Fraud, Etc. (3 counts) he got 7 years but was already a Department of Corrections offender..she has never been in trouble before...we are wanting to get custody of the child because we haven't seen her in over a year because we have no way of getting in contact with her or her family and they let the mothers father take custody of the child and we are currently having to pay him child support..(i don't think is right) if the mother is in jail and can't care for the child shouldn't the father have the option? Sorry i am getting a little off subject but was just hoping if anyone could give me any information. Thanks
