Drug addictted for rehab - afidavit

I have a son in jail for drug addiction and we are going to court on monday, his girlfriend which is also addicted, and him tried to kill us just before christmas and both of them were arrested, my son was kept in jail for he did not comply with his parole rules, girlfriend was released, their 5 year old daughter Kelly was placed in our care and we are now trying to get custody of her until both of them are clean and has sorted their lives out.

With things going as they are now, monday's case will most properblyresult in Kelly going back to the mother, for the social worker their said all is fine with the mother,but we have been recording all her telephone conversations with Kelly and more then one of those still proof to us that she;s deceiving the social worker there for she's still on drugs and now we have been advice to write a afidavit in which we plead for the judge to send them both for a full rehab program, for both of them pose a danger to us, their daughter and themselves and we do not know how to go about it, is there perhaps somebody who are able to assist us.

If you genuinely feel in danger go to the police and make a statement, but be clear in your mind that this will have serious consequences. It's not a question for an attorney. It's a question of moral conscience. And what is best for the little girl. There exist in every state a child protective services organization and an adult protective services, but the first step should be the police station. Bear in mind that addiction per se does not necessarily mean a person will be a bad parent, and a judgement should not be made on that basis. The issue of genuine danger or threat to human life is a horse of another color. I am very concerned over the statement "tried to kill us". Not having been there I cannot comment on this allegation, but if true the situation is very serious indeed. And the other question is whether the girlfriend had anything to do with this. To cut to the chase, IF you belief your life or the child's life is in danger go to the police now, explain the situation and follow their advice. This is not an issue for a consultation with an attorney.

HI - so sorry you are dealing with this.  You've posted in an addiction forum where we support each other, I'm not sure anyone can offer you much here as this really sounds like a legal question.  I'd consult an  attorney.  There is also a forum for people living with addicts for family support - you may find someone with a similar situation there.  Best of luck.
