Prescription forgery - Stolen R/X Pad!

by kleen4me, Jan 02, 2007 12:00AM
Hello, Any information anyone can give me w/regard to forging an R/X on a stolen R/X pad would be greatly greatly appreciated & I thank you so much in advance for taking the time to read & respond.  My BF went to OBGYN for endometriosis pain & saw a nurse practitioner. When the nurse stepped out of her office, she opened her desk drawer and took her RX Pad. I just learned of this last night.  This occured about a month ago.  Since then, she has gone to 5 or 6 different pharmacies & googled how to write R/Xs & had all successfully filled. I believe it was for Lortab. She is afraid of getting caught for her recent past forgeries in the last 30 days. My question (I have been researching all day & can't find anything definitive), Is there a way for these forged RXs to be audited & could she be in trouble down the road even though the RX's have been filled and consumed?  If she does NOT forge another prescription, could she still be in trouble or do you have to be "caught in the act?".  As we speak, is it possible the nurse practitioner knew her pad was missing when my BF left & perhaps called the DEA to report it missing & if so, could they be building a case against her? SIX times. In your opinion, what is worst case scenerio?  She does have 2 DUI convictions and other charges that are documented but were not convictions (resisting arresst, ect) so she has a record. I am new, but hopeful someone can give me insight to whether or not she could be prosecuted down the road, or is she OK as long as she does not do it again? I would be so grateful to any insight or links? THANK YOU

She should be okay if she stops now. She has been lucky so far, but luck always runs out(:

Thanks Matine. Can anyone else confirm this? I am nervous for her. I am in recovery and she WAS, but screwed up before Thanksgiving.  She came clean last night to me.  SIX prescriptions is a lot and I would be PO'd if I was the DR/Nurse Practioner.  Surely they can find out if their stolen pad is being used? Would they have to catch  her in the act?  I read the thread on the younger kid that posted on 12-30 where they stated that some officials (FBI/DEA..not sure) was following them around did not arrest them but told them that they had "evidence" and I believe this person/young kid had said that they were going in today (Tuesday)to make a statement or something to that effect.  Seems like they easily could build a case against my BF?  Obviously she had to show her ID, ect.  Just don't know if that is enough "evidence" to pursue to actually prosecute her.  What if the NP submitted her name (BF's name) to the D.A., & the DR/NP wanted to prosecute?  She is probably on the video cameras unless they are wiped clean every 48 hours or so...???

The DEA number she has been using could be audited if it looks to be used excessively for the SAME narcotics for the SAME person. Meaning, if she is going to different pharms using the same DEA#, prescribing herself the same pain pills----Yeah, I think that is very traceable and questionable.
She neeeds to QUIT IT, NOW cuz she is going to get caught. And thats alot of felonies.
She hasn't been caught yet cuz the DEA# she is using hasn't been questioned yet but believe me, the more she uses it for the same pills and the same name....they are going to start questioning it and then all hell's gonna break loose.
Tell your friend to...what's it called? Oh yeah, QUIT WHILE SHE IS AHEAD before she winds up in prison.
Be her friend and do all you can to help her get clean again, refer her to this site and we will do all we can to help her, too.
She needs to get back into a support setting to help her!
Send her our way!!!!!!!!!
:)
Take care
Scarlet

I know this much.

Rx's don't filter back to the Drs office unless there is a sign of some abuse or the pharmacy can't read the script.

The Rx does stay on file in the Drug Store.

Your friend is not be in the clear just yet. I can only speak for the process in Texas, but all prescription controlled substances are entered into a data base. If suspicious activity is detected, the case is turned over to the DPS for investigation. Just because she hasn't been arrested yet, doesn't mean it's not going to happen.

She definitely needs to stop the forging now. I don't know about the state you live in, but she would likely get offered probation here, even with her misdemeanor record.

Lortab class 2...percs are class 3 and would have been faxed to Dr. Very stupid (or should I say addict behavior). Class 22 meds are not tracked likeclass 3 which include Oxy, morphine (over 30mg) and any of the stronger meds, Class 2 meds do go in database and its possible it will be caught but unkllikely.

Thank you to everyone who responded. I am an addict, but, WOW, I, like many of you, had got my percs & oxys by my DRs and/or a person I know who has extras that is in pain management.  I would never entertain the thought of stealing a rx pad or even forging a current prescription to change the dosage the Dr wrote.  When she told me of this the other night, I thought for certain there would be some kind of way to audit what she has done and that she would be looking at jail time.  Unbelievable she got away with this 6 times.

she will definatly get caught. i am soory to say this i am currently in the same situation, 2 narcotics agents and a police officer came to my home 2 days ago and arrested me, i was #1 going to different doctors to obtain the same drug (percocet) which is considered doctor shopping and is a 4th degree felony and i forged a perscription, that had it all. Narcotics agent just started in february of 06 a centralized data base, when ever a perscription for a narcitic is passed to a pharmacy it goes to the narcotics agency and is red flagged, expecially when there is multiple perscriptions. i thought i was in the clear i did it 2 months ago, and they just arrested me 2 days ago, although i have to honestly say i really did not know it was illegal to go to different doctors, and i am truly remorsful for what i have done, i never went into this asking to become addicted, it happened to me and now i am so scared, i was perscribed these pills from a recent knee surgery, before i knew it i was addicted, i truly feel like publishing what has happened to me for everyone to read, it is scary and no one is to blame, i believe it was not my fault, when you experience withdrawal for the first tiem you never ever want to go through it again, i will not.. i am getting help

hope this helps

Hi there, well did you actually FORGE the script from a stolen pad? not sure if we are talking apples to apples.   Also, lortab is one class lower than percocet which is opiate based.  Now I have rec'd 2 different perocet rx.  One was for surgery and one was from my dentist for a root canal last year.  That is not DR shopping and the feds have no legal right to interfere if I indeed rec'd 2 scripts from two different drs around the same time.  Both were legitimate (both not written on same day, but with a couple)  So that is wierd you were arressted for what you are saying.  Did you forge the RX?  If you did not, why would you be in trouble? Are the other charges pending other than "DR Shopping" which, btw, I find hard to believe anyone could get arrested for going to 2 DRs to get same medicine. I'm 42 yrs and am certain this has happened to me (& legitamately) over numerous occassions. That alone in itself is not a Class D.  BTW, if you don't mind me asking, were you caught ever in the act of doing something or did someone out of blue just serve your papers?  Curious. Thanks in advance

I never forged, and never stole a prescription pad or form. This is what happened.
I had knee surgery in august of 2005 and was seing a pain mngmt. dr. he was perscribing me percocet on a montly basis for about 8 months, he left the practice and the practice obtained a fill in dr. for about 3 months, he also was perscribing me percocet on a monthly basis (180 at a time) then the office (the same office) and for the same treatment obtained a full time doctor to take over, he has been there for the past 4-5 months, he as well was perscribing percocet to me on a monthly basis. In addition to all of this i was also seeing a different doctor all together for my migraines, which i truly do suffer from, he also perscribes me percocet on a monthly basis, in between all of that i as well as you had tooth surgery and received a script for percs for pain. I legally was going to doctors and was legally being perscribed percocet, I honestly have to admit that although i do suffer form migraines i was starting to go to the migraine doctor more often because i bacame physically and mentally addicted to the percocet, without wanting to and without asking for this. I guess a red flag came up now that all pharmacies are linked, the red flag was due to 5 different doctors and the amount of the perscriptions. I was able to clarify and prove to the narcotics agents that 3 of the doctors in fact were in the same practice and treating me for the same thing, they did wipe those 2 doctors off there warrant and my charges, but they did explain to me that it is now a law that is you so much as see 2 different doctors and are obtaining the same narcotic it is considered to be a felony and called dr. shopping. They came to my home, arrested me and put me in jail, thank god my husband came and bailed me out, now i have to wait for my court date. I called 3 well known attorneys in my area and they want me to fight it. I truly beleive, especially after talking with numerous people that innocent people are being charged for something that they truly did not know was even illegal, hardly anyone knows of this law including most attorneys that i have talked to. But in order for me to help myself i can't think of that right now, i did see another doctor in hopes to obtain percocet because i would get so scared when my other perscription was running out, i did not want to go through withdrawl, which at first i did not even know that that was happening to me, no doctor ever explained to me the addiction and dangers of this drug, had they done i would of never taken it and the amount.
