Stealing Scripts

K, i believe my husband stole and refilled several scripts.  Whats the law about that in NY? Anyone know?

Anyone know how i can get a print out from the pharmacy's of his scripts?

A spouse cant testify against a spouse ? not so. A spouse cant be FORCED to testify against a spouse.

3 Years??? That is not so. There are many things that could happen should he get caught!

Don't forget a wife cannot testify against her husband and vise versa. you in NEW York call Adcare in Worcester they take all kinds of insurance and accept various medicaid plans from many surrounding states. They will pick him up in NY and bring him home, The length of stay depends is up to the insurance co, If they ask if he has any legal problems the answer is no! no! no! The HIPPS prevent them from releasing his name, They use methadone for opiate w/drawl and Librium for alcohol w/drawl. BUT it is a lot of meetings after the detox face is over in 5 days.

The best in New England is Brattleboro Retreat in Brattleboro Vermont, they have tennis pool, baseball field, evening n/a meetings, and canoes as it is surrounded by a lake. the food is awesome and you are encouraged to eat eat eat. Once again if asked any legal problems no no no no no!!!!!

All the above posts are correct. Once the pharmacy finds out despite your good intentions they are required to file a complaint with the local DEA office. You don't want them on your back, You live in a state where there is a prescription monitoring system, That is set up to pick up on drug diversion, Unless he was smart enough to use a different DOB and pay cash not run them through your insurance. I don't know if it is a felony in NY as it is a misdemeanor on CT. GET on the web site and type in on yahoo if you got it. new york prescription laws as you type you will see various options pop up even legal defense, But go to a free attorney consult and find out what hes facing. What drugs are they and did he use his own name with same DOB and address. If its his first charge you can probably get out for $1500.00 for attorney and 300.00 court cost. But clean your house out now as far as pharmacy bottles receipts. Hopefully he did not use credit cards, If you have insurance have him go inpatient detox now for as long as possible, the police cannot take him out of detox, Because there is no way he wants to go to jail dope sick-----but talk to no one about this including friends, He may owe money for drugs, someone would love to drop a dime on him, How long has he been doing this?-----------------NOAH

I agree with SPOOKED.. DO NOT Contact the pharmacy. This will only cause more trouble 10 fold. Confront your husband and get him treatment....

Don't know a thing about NY law, but.....

For God Sakes, what ever you do, DO NOT tell the pharmacy what you think happened!!!! Why don't you just confront him (or if you feel you must conduct some sort of investigation, without telling them why call you insurance carrier and ask them for a printout of the benefits which they have provided to you over the last month, year or whatever).  Don't do anything that might cause anyone to scrutinize his old scripts or cross-check the scripts with the M.D. whose name is on the script!!!

Regarding his dependancy and stupid behavior, try to deal with it yourselves. Whatever you do, DO NOT ask "the system" handle the problem for you. By handling it yourselves you will have access to...each other (which you won't if he goes to jail),  better care, better counseling and far less heartache.

The first thing I would do, however, is slap him upside the head for being such a stupid (use your own word here).

With respect to the legal ramifications (which is something I do know a little something about), I would urge you both to contact a lawyer before speaking with anyone else!!! If no one is asking questions, great, but you may still want to consult an atty to be prepared just in case.

If you have ANY reason AT ALL to suspect that you or your husband WILL be questioned, the I suggest that you call an atty ASAP.  No matter what you ultimately decide to do with his case  (whether he ultimately decide to confess/plead guilty or just keep his mouth shut and make them prove whatever charges they decide to bring beyond a reasonable doubt), in the vent that there is some type of investigation or charges brought, it is ALWAYS better to have legal counsel guide you through that process. That way, you greatly increase your odds of obtaining the best possible outcome.  No matter what they might say, if the Police are investigating you or your husband, they are not "there to help you" -- your atty will do that for you. The police are there looking to charge someone with a crime. Don't forget that. It won't be any "easier on you if you tell this nice officer the whole story right now."  It will just make it harder on your husband and his lawyer later.  Let's be absolutely clear here, I am not suggesting that anyone should lie or commit perjury, I am simply saying that more often than not it makes sense to consult an atty before making any statements to law enforcement.

Oh yeah, one more thing, whether or not he has any prior drug charges/convictions on his record, in many states, possession of over a certain # of pills constitutes a basis for charging him with "intent to distribute" or "intent to traffic in narcotics" and that kind of charge can often mean jail time even for first offenders.

I didn't mean to be so alarming, but I really don't think you should go telling the pharmacy. Once you do that, the whole thing is no longer under your control.

It will carry two felony charges........
Illegal possession of narcotics
Illegal possession of narcotics by fraud.......

If they press charges he is in deep ****.....
if he has a clean record and a decent lawyer inpatient rehab and probation fines.......
if he has drugs on his record jail time could be a real reality.......

Talk to ur dr., or tell the pharm. what you think happened,,, they will give you a print out. If not,,,trust me,,the police can get one.

Yes,,,,you can get a print out. I was just indicted for doing the same thing. In Ohio it is a 5th degree felony. If he did something wrong, the pharmacy should have flagged it.
