Workers Comp~Blacklisted?!

Heres my story, any advice would be greatly appreciated. I am about to be 30yrs old, and I work(ed) in a warehouse. I had barely statred this job and not even 2 weeks later I was was driving a Tugger Machine (that pulls carts) I had got to my aisle to unload boxes and stepped off the machine to pull the brake up when the machine malfunctioned,and went in reverse crushing my tibia and shattering my fibula. I was pinned up against 7 stories of shelves while the machine continued to run over the top of me. I am on workers comp, and was taken to ER,(8-2-2007) treated by surgeon on call, who did not want to do a surgery at that time, instead had me in a full leg cast, and told me to follow up with him, so I did. Almost 3 weeks later (8-22-07)the dr. told me the bones were not healing the way he wanted and insisted on surgery, so I ended up getting 8 screws and a metal plate in my right leg. After my dismissals from the hopsitals he had me on Darvocet for pain, and it was not helping, so he switched me to Hydrocodone 7.5mg. The instructions were to take 1-2 pills by mouth every 4-6 hrs for pain, which I was in alot of. He prescribed me 20 pills at a time so it was a 3 or 4 day supply. I had continued to see him, and still to this day have alot of pain (though some days are worse than others) however after a while he stopped treating my pain and refused to give me anything, just told me to take ibuprofen, so I did~It did not help. I was taking sometimes 8 or 9 of the a day, but no relief. I tried to talk to him about this and how much I was hurting but it was as though he was hearing me, but not listening to me. The pain got so bad at times, I was taken to the ER for treatment, though I had a treating dr. for this injury. I've been going to appts now for 5 months and at least the last 4 everytime, I was in and out of the exam room in ten minutes tops, he would take an x-ray, and dismiss me. He explained to me there is NO way I am in any pain because MY LEG IS HEALED. I know how much pain I have, but he did not seem to care. I then got a letter a few days ago to go to a different Dr. for my impairment rating, not knowing what to expect. However I went to see that Dr. and he was in shock that I had been in NO kind of Physical Therapy (though I had even asked my treating dr. that several times, and he told me it was not needed) Imp. Dr had my medical records (which I had also gone to pick up before my imp. rating appt.) and he said that "HE WOULD HAVE TO DISAGREE THAT I AM HEALED, AND I AM NOT AT MMI. HE STATED IT WOULD BE AT LEAST ANOTHER 9 MONTHS TO A YEAR BEFORE I AM COMPLETELY HEALED." He advised me that I should consider finding me another Dr. who is going to treat my pain, and get me into therapy and make sure that I am taken care of. After reading my medical records, I called my treating Dr. and my attorney and I requested another Dr. However, in my records Dr. M (treating Dr.) stated false accusations about me, for 1 saying that I had lied to him about having to go to the ER for treatment,(I had the discharge papers for proof) he also stated that I was abusing narcotics by taking too many of them, though I took them as directed on the bottle. I have been reading up on some things that my attorney had told me, and I never knew it existed, but my Dr. was blacklisting me, which is illegal. I was not only mad as hell but I was hurt and felt betrayed. I did everything he asked of me as a patient, and he never discussed any of these matters with me in person. Him and the staff would smile in my face and obviously talk behind my back. So my attorney found me another Dr. but I had to drive today for 3 hrs to get there because of my insurance (Network Dr.s) and that alone was a task in itself to get there, and once again, I was handed IBUPROFEN, and told to come back for therapy in 1 week~I AM IN SHOCK! How can this happen to patients? I understand that yes, there probably are people who misuse a narcotic, but I AM IN SEVERE PAIN, and its as though my Dr. has ruined me for a fair treatment. I was not taking them for the fun of it, but because I can barely even stand up to get out of bed sometimes, and if the weather is cold, I can not go outside because it hurts even more with the hardware in my leg. I have NEVER had any problems with any drug or alcohol problems in my life, because I choose not to do those things, I've seen what it does to people. I dont even like to take a tylenol when I have a headache, but I have no choice when my leg is swollen 3 times bigger than it should be, and in pain 10+ on a scale. I have worked in corrections for many years, and been in the military~so why am I being treated this way? It's just not fair, and I don't know what I need to do next. All I want is to be treated like any other patient, and get respect from a Dr. that I am comfortable with, but that Dr. has ruined my judge of character, and I am furious because it seems as though I am crying out for help,and only getting jerked around from not only my Dr. but my workers comp insurance as well, I would give anything to not have a broken leg but I can't change it. Now I am stuck with this hardware in my leg, ugly scars, and not to mention by self being, depression, stress, and will never be able to do all of the things that I did before. I feel helpless, and just need some advice from any dr., or someone else who may have gone thru something similar... I am about to just give up but its not fair that this can happen to patients, especially those who have no history of abuse and who really are hurting. They are getting paid to treat me, but I barely even get 5 minutes with them~What do I do?!? Please help! Thank you in advance for reading my story. Hope you are starting off 2008 better than I am!

I've had some experience with workmans comp. There are laws for us and also loopholes for them. First of all, after you initially see their doctor, you are free to choose your own doctor at their cost. Not from some insurance list. Maybe you should get a new lawyer. There use to be this organization for people's rights on workmans comp. They really helped me alot. They are passionate about it. Can't remember the name but do some web searching. There is alot of crooked stuff going on in workmans comp. They all work together. The doctors, the insurance companies, the work places, and yes the lawyers.

Your story infurriates me! Please don't back down.They owe you alot. And you have one hell of a lawsuit you can pursue. But thats a whole nother story.

Kinda of agree with some other people.  I finally realized the docs can't help and being on vics for 4 yrs isn't going to work.  So I got off and haven't had a nomal life yet in probably 6 yrs.  So I don't know how to help but I have finally been going back to the gym since about 2 or 3 yrs.  I am sore as hell after I go but It is making me feel beter about myself and I think it will help me in the long run instead of the drugs.  Works comp are a bunch off a-holes and they never believe you because too many people try to screw them over.  But hope you find what you are looking for.

IT SUCKS THAT YOUR IN SO MUCH PAIN!!!  I know your going to HATE me for saying this but your di**head Dr. did you a favor in a weird way......
You could have become addicted SOOOO EASY from other meds.  Belive me - I'm IN PAIN just from being stupid & givin the meds.  
Just be glad your not hooked on something & dealing with the depression.  Ibupro. doesn't cure the PAIN TOTALLY - I KNOW but, it also SAVES you from a life of hell.  Well at least the depression/ hurting your loved ones &  job.  My heart goes out to you.  STAND STRONG & use the Ibupro./ Hot/cold patches & run....

FIRST IM SO SORRY ABOUT YOU PAIN , MY BOYFRIEND HAD A SIMILAR ACCIDENT BROKE EVERY BONE IN HIS FEET BOTH FEET ROOFING ACCIDENT. I ONLY WISH HE WAS BLACK LISTED. HE TOOK 120 PILLS IN TWO DAYS LAST WEEK NOT BECAUSE HE WANTED TO DIE,BECAUSE HE WANTED TO GET HIGHER. HE HAS BEEN ADDICTED TO PAIN PILLS EVER SINCE 3 YEARS AGO. DO YOU BELIEVE IN DIVINE INTERVENTION? I ONLY HOPE THERE IS NO IRONY HERE, THAT YOU MAY BE COMING BACK LATER TO THIS SITE TO GET OFF THE PAIN PILLS YOU WANTED SO BAD.

I have a word of advice for you. Tell your doc how often you are taken the Ibuupropen, and that you tried Naproxen and aspirin and now when you take them they are causing you chest pains. Now, he will try to say it is your stomach, but tell him it feels like a heart attack. Simple! NSAID Allergy. I have it which sucks by the way. If they try to give you Ultram, don't take it either, it lowers the threshold for seizures and othe things do too and you might not know which or what. You can take that for experience.

hun, get your attorney back into it.  and/or get another attorney.

this doesn't sound fair OR legal.

don't give up - keep fighting!  you have a right to proper medical treatment.

That sucks that dr was so cruel and he put you in addiction liability catagory to cover his mistakes and shortcomings as a true provider! Lets see...we have a board certified dr vs a pt that was given a narcotic that is the second most highly abused drug available. That "DR" saw an oppurtunity to weigh you down with those who have legitmately taken advantage of a dr to feed the addiction.
I take vicodin 10mg and just saying it to a phramacist for a refill makes me uneasy, I know their red flags are immediately raised and make sure it is okay to obtain my script. Their maistake can cost an entire pharmacy its license, same as a dr office. However, many physicians and pharmacists power trips can put you or someone that has never dealt with any narcotic before in the "addict hot seat". The "dr or pharm" entire attitude changes to down right rude and everyone walking in the door with a narc prescription is looking only for his next fix. They should never be rude to someone they can't prove is an addict just because they request a refill or come in with a script. Either way every erson deserves respect and a chance, unl proven without a doubt they are obtaining many scripts in a short period of times by different doctors, still then the pt may have no insurance and has to go to different urgent cares or ER facilities based on how much time they have or whatever is cheaper. continuous behavior of this longer than a month or two may get you some nosey questions.
Tell your attorney, according to the Narc Institute Survey of common drug seeking behavior, What drug seeking or abuse did I exhibit to deserve this unfair treatment?  Go to EVERY and ANY pharmacy you have been too in the last oh...6 months (to be secure in your defense) they can print you out a spread sheet of every script w directions on how to take, and qty# obtained through that pharmacy with date, time, doc included, fight for it if you can prove him wrong. Blacklist is not easy to get away from if you can. Due random drug tests to prove you have had nothing since Dr jekyl gave you some. Agree to any form of proving your innocence because not a single doc or pharm will ever be fair with that garbage on there.

I feel your pain the same thing happened to me except different job and different injury doctor same situation but he told me i did not have pain and to quit taking my pain meds that my family doc had prescribed he was a workers comp specialist so i tried to come off of them and oh boy that was a nitemare. Since then i have an attorney and i personally reemed this uncompassionate ____worshipper out because dont become a doctor if you dont care! i asked him have you ever had pain and he said no and i said well you are in for a rude awakening and you are not my doctor and i will see you in the court room and you should be ashamed saying i dont have pain  i wish their was a pain detector test and i would be first one in line.You have been treated wrong and i have and we will be compensated for it and if you believe in this verse vengence is mine saith the lord!Good luck! Your right its NOT fair,,, I was treated basicly the same way during chemotherapy in that drs were judgeing my pain levels and making assumptions about how much pain I was in. This practice was supposed to be halted by the pain level scale you see at the doctors offices... but when you say your pains a level 6 and you are still given the weakest pain meds.you know they arent hearing you or worse yet, think your lying. Its WRONG perioud,,, NO ONE can know your pain levels and experince except you. It sounds like your heading down the right path as far as getting an attorney ect,, but I know that doesnt help you NOW.

Please feel free to PM me through this board if you'd like to discuss it with somone whos been in that position. I would also suggest you look into a plant called kratom which is being used by the general public now for pain relief as well as to help control opiate withdrawls. Its fairly expensive, but its legal and you cant overdose on it because doing so causes dizzyness and nausea when to much is taken.

have u ever considered going to a pain management clinic?  That is what u need.  i would look into that regardless of the insurance they would be a great help and give you meds that you need to manage your pain.  look in the phone book for and call for a consultation
