clean and sober . legal issues from the past

Im now around 112 days clean and sober. I went through 8 months of rehab and while trying to get clean and sober i relapsed and pick up a shop lifting charge. they tacked some fancy names on it and called it commercial burglary and petty theft. this is because they said i had intent to steal the items before i went into the store. Well now im in negotiations with the da and they want me to go back to in patient rehab to get the charges dropped. 28 days in rehab. ive never gotten more than 60 days while in in patient. i got my 112 by going to meetings, working and just doing ordinary stuff. I cant go back to inpatient im starting school i have a job my own apartment and im doing well.

I had a court case today. Its really bugging me because my lawyer hasnt called me yet to let me know the news. Im trying to turn it over to god but its hard so i decided to share on this site because i can be more open here than in an AA meeting.  If the da sticks with his demands im either going to have to sacrafice everything i have and go back to inpatient or take the charges. If i take the charges im screwd job wise and if i go back to inpatient i will be set back months. I dont know how to deal with this. this is like a stuck point for me causing me alot of stress anxiety and fear. not good things to have in such early recovery . Has anyone dealt with a situation like this in sobriety? can anybody relate or have some advice. I some how need to get past this with out relapsing

If it came down to it i would go back inpatient if u have no prior record...lots of things are involved such as prior law problems...if i had nothing on my record i would avoid that at all costs......if u get to go back to court, can u talke to the DA and state exactly what u have just said here?   tell the lawyer to let u talk...if u r sincere..and it is a good judge...he will feel your sincerity and perhaps let u off easier...like with no inpatient or conviction...just a thought

A few years ago I had some legal problems myself. In the end the charges were dropped. Look at the bright side and from what you said you not facing jail time. Maybe your lawyer could talk to the DA and explain that you are clean and they will make you go to an outpatient program. Call you lawyer and tell him to push for outpatient.

I agree with worried, talk to the judge open and honestly. Lawyers cant convey your regret. But also, your clean...thats all that matters. STay the course, the rest will work itself out one way or another. You gotta stop worrying about things you cant control. Just worry about the minutes before you and take things with a clear head and solid strength. It will all work out, it always does.

DA accepted my previous treatment as acceptable. dropped commercial burglary and after a year of non intensive probation petty theft is being dropped. It is truly amazing how things work out when  your clean and sober. Got four months in a couple of days.
