Adopting my Step-Brother

I need opinions and I am not sure where to post this! I want to save my step-brother from a really bad situation! The problem is I dont' know how. They have already been investigated by CPS, they have the cops out all the time but still noone has taken this poor child from them!

I want to adopt my step-brother but I don't know how to do it. Worst part is if I do it will cause a huge fight between me and my dad and he is on his last leg....meaning he isn't doing well health wise!

Let me give you a little more info about his situation.....My dad is a meth user and I mean a big time meth user, his mom is as well as well as pot head, pill head, and anything else she can come up with! She is not all there...thinking drugs have fried her brain.....she has no business trying to raise him and has had all her other children taken from her! I don't know why or how she has been able to keep him all these years!

Bout mid month they are out of food and I am having to put food in the house, I had to buy them a hot water heater so that they would have heat! They live in trailors that I won't let my kids go into....the house is always dirty because his mother wont get off her *** and clean..which is weird seeing how she does meth!

They go dumpster diving for Christmas, and his birthday and unless I throw him a birthday party he doesn't get one! He is now acting out bad...throwing fits bad enough to brake windows and doors, skipping school and even hanging out with the bad kids. What can I do to help him?

Being a step brother/sister does not mean that the court will allow you to adopt your step-brother. There are many reasons that needs to be taken in to consideration, one is the father, if he is not deceased then he has the legal right to get custody of his child as long as his rights were not terminated. Then comes the grandparents that may have the legal right to file for guardianship or custody, depending on the laws. Also did the mother have a will.

I think I didn't state clearly what is going on. Let me explain more.

My dad and stepmom are not good parents at all. She claims that she conceived my step-brother thru rape so as far as a father is concerned nobody knows who he is.

My stepmother is still alive. CPS is investigating them and it looks like they may remove him from the home. If they do I would like to adopt him. Her side of the family has disowned her and have nothing to do with Charles (my step-brother) I am the only one the boy has that shows him any kind of affection plus I make sure all his needs are met.

That is why I am asking how hard would it be for me to be able to take custody of him if CPS removes him from the home!
