I have seen a surgeon and was told there is no explanation why I am not paralyzed. I have NO spinal fluid form C3to C7. The nerve canals are COMPLETELY pinched off. I am losing use of my left arm due to neurological damage. When I look down, my vision blurs due to spinal cord pressure. I have had to quit work, I am, or should I say was, a hairdresser for 26 years.  The surgeon told me if he had his way, he would have had me on the table that afternoon. And "not to make me walk on eggshells", BUT, do not drive, work or be around crowds because if I were to be bumped into that is it all it will take to completely "do me in".  I was in an MVA June 5, and I am still waiting on insurance to "approve" payment on my procedure. There is only a 25K policy limit, which will be exceeded. They will not release it and I cannot have my surgery until they do.  I am having to get into my Underinsured Motorist Policy and am totally at the discretion of the insurance companies. Meanwhile, I am in extreme danger of paralysis. Can you say LIVING IN FEAR???? Does ANYONE have any advice on how to expedite this situation? Or knowof any surgeions in Oklahoma City who would or could HELP ME????? I hav an attorney on it, but everthing taked so much time that I feel I don't have.

What is the insurance company's reason for not releasing the funds? They are suppose to cover your care that the doctor says you need, atleast the $ coverage you have in your policy. They can process a claim in 15 days. It has been more than 2 months. Insurance Company's are under State and Federal Guidelines. Contact the Insurance Commission. They will find out what the reason is for holding back money for an urgent surgery, in which the person is in extreme danger. You probably can e-mail them, but you can call. Make sure you get the words out of being in extreme danger while waiting for them since June. You don't want to get bogged down in paper work.

You need to get on your attorney to get the ball rolling. Tell him/her that your  doctor says you need this NOW. Your attorney can expedite this and should. If they refuse you need to file a complaint with the bar as this is a part of his/her job. They agreed to take your case and needs to provide you adequate service.

If you can not locate the Insurance Commission, Go to the State Corporation Commission. I have gone through that before over a business violation and they called them directly and called me back. Since your problem puts you in immediate danger, they will help you right away.  While working on the attorney you can report the insurance company and they may get involved with the attorney also, because he is still under a business license. He would get 2 whamies at once. Between the State Corporation Commission and State Bar Association, he will be hopping. The insurance company does not want to have a problem with not obeying the state or federal guidelines either. They can void their license, fine them big time among other things, especially if they have been reported before. They have the power over them. I believe when the State Agency that controls them gets in touch with them they will be more than willing to clear things up right away. Just remember this, if they send you a check or an agreement on the payment, it is an acceptance of settlement. DON'T SIGN ANYTHING, even if it is from your attorney IF YOU ARE NOT SATISFIED. Tell them no. Send the check back with UNACCEPTABLE across the front or anything else they send you and have a copy made for your file with that written on it. If they say this is all we are giving you and nothing else, and it is not acceptable, say it is UNACCEPTABLE and stick to it. No matter how ugly they get with you to pressure you to accept, stand your ground, hang up, you don't have to hear what they keep saying. They bank on how bad you need to get your surgery done and you will take anything they offer if it would help and that is all you think you can get. They will send you the check of what they say they will only pay, and by dangling it in front of you, hope you will cash it and they are off the hook.They tried that mess with me. All they succeeded in doing was putting more fire to the flame. I got exactly what I wanted, when I let them have it and I wasn't ugly talking, just factual.

About a year ago, my neighbor's trees fell on my house and did big time damage. I had contacted every legal authority in my county during the prior 2 years, nothing. There were no county or state laws covering the situation, although it put life at risk. When the damage happened, we both had the same insurance company except the neighbor's was through a different agent. I was treated disrespectly and like I was some kind of crook because I refused to accept their check for less than half of the cost for damage. This went on for a while. I sold insurance through a company I worked for for 13 years. It took 1 letter sent certified (had to be signed for-- record they received it) to the supervisor. 2 days for him to get it and 1 day to settle. I made sure I told him I sold insurance for 13 yrs. He knew I knew about the laws and who to go to. The adjuster called me and was pouring with appologies till it got right syrupy. I had also reported my agent because of his lack on doing his job. He got in trouble, too. So, like MarMar said your attorney is at fault for not doing his job. He knows the laws and sources to go to, why hasn't he? He can be held responsible if he lags back and something happens to you, as well as the insurance company. They will be covering your medical needs for a long time. Insurance companies (some) and some lawyers both rely on the party not knowing the laws that protect them. There are many that settle for less or get nothing from insurance companies because of lack of knowledge. Some of the attorneys will pray on the same thing. The longer they drag it out, the more money they get. You can go to the Better Business Bureau site and look at the insurance co's records of how many people settle for less or nothing.
