pinched nerve cause by nerve bulge from car accident

Hi everyone, i'm a male 27 years old.  A year ago, on my way driving to work, i had an accident.
The guy was trying too fast hit the rear of my car when i have made a complete stop.  As of a result, i had a dics bulge  at L4, L5 and it pinches against the nerve.  It shoots all the way down the right leg. I've got three epidurals and it's much better.  
It's hard to imagine how tough life would be, how to deal with pain for years to come.
I just hope that it won't get much worse.....
My concern is how do i find a way to stay active, get exercise regularly to strengthen the muscle and mainly to stay healthly.
My doctor says swimming is the best but i'm scared if suddenly my leg got numb and i can't swim no more and might get drown...LOL
I'm thinking about biking on a stationary bike.  You know a bike that sits still when you bike.  I think you know what i'm talking.  I really dont know if that is a good exercise for me.
Besides that i know stretching is really good for lower back pain.
Anyone have any ideas on how to exercise pls post it.  i appreciated.

Hi,
I was also hit by a driver and have a pinched nerve (L4-5) because of it. I understand your dilemma about wanting to get in shape (or be active) but don't want to mess anything up back there. I have been very athletic all my life, so it is quite a  big change to have to "baby" myself...it is annoying as hell! LOL

I am able to ride a recumbant bike. That is a stationary bike that you sort of lounge in, not an upright stationary bike (I am not able to use that kind because it bothers my hip/leg too much). I don't know if you are able to walk very well yet, but that is good for strengthening as well. I haven't been able to do the walking or use weights on my lower body since the crash...I am hoping to get back into it.

May I ask how sitting is for you before and after the injections? Also, have you had weakness? Did the injections help with your weakness and numbness? One more thing...do you feel like you did pre-accident yet? My crash was Nov 2006...I want the old me back! LOL

I have a disc bulge of 4mm, and i pinched on the nurve.  I am walking just fine, but for standing and sitting for an extended period of time, my right leg would start to feel the tingling and pain but no numbness. I still can tolerate it.
After the injections, i can sit longer, the pain is less.
i have no weakness.
the injections help the pain, about fifty percent better.
pre accident, i have some lower back pain for a few years so i quess i probably have a tiny bit of bulging.  i play all sports without any problem before the accident.
I know it's a big change in our life but what can we do. there is no cure for this, all we can do is take good care of ourselves to prevent further damages in the future.  sometimes i feel really bad...
by the way, how much did the insurance company compensate you for your lost.  did u sue the other driver.  my case is still not close yet, my lawyer is not very happy cause the guy has a low insurance coverage.

Yeah, I also have bulging discs that are pressing on my nerve. It's good to know the injections helped your pain.  Do you think you will need more injections? Any talk of surgery?

When you say "sometimes you feel really bad" is that because of your situation (can't do what you want) or because of your pain?

I was going to ask you the same compensation question, LOL. I have not settled yet, because my doctor says I will need surgery if the injections do not work. The other party was 100% at fault by running a red light. I have an excellent case. I can give you a bit of insurance advice if you like. It doesn't matter how much insurance coverage the other party has, if you have decent insurance, you can sue your own company to make up the difference. It is called underinsured motorist insurance that we are equipped with in California. I am assuming you are from Cali because you are a Laker's fan. This is how it works. Say you sustained $75K in medical bills & pain and suffering, but the person that hit you only carries a $50K insurance policy. You can get their $50K and sue your own insurance company for the $25K. But....you can ONLY do this for as high a coverage as YOUR policy states. If you ONLY have $15K coverage and the other party also only carries a $15K coverage, you can only get a total of $30K (the two company's combined). Sorry if you already knew all that...just sharing what I know. Do you trust your attorney?

i dont think i need more injections since i got three of them and i the last one was about three months ago.  i'm ok now, i can tolerate the pain...
oh, sometimes i feel really bad because of the situation, all the mess that's going on.  Thinking about having a family and a kid and working with the back problem make me feel bad.  
Thanks, it's good to share the advice with you since we both dealing with similar problems.   I understand what you say about the policy coverage,  but what i heard is that: I can get the difference between my UM and the other pary's coverage Only if my UM coverage is high than the other party's policy.  Say if his policy carries 15K and my UM is 15 then the difference is 15K-15K = 0, so the total i can get is the guy's policy 15K and the difference which is $0.  If his policy is 15K and my UM is 25K then i would get th difference 10K, (25K-15K=10K) and the guy's policy which is 15K, then the total is 25K.  but according to you i can get the combine which is 30K.  I will find out with my lawyer.  

ok do i trust my attorney? i asked myself a few times, i actually tried to change lawyer about 4 months ago but he sat me down and convinced me to stay with him.  I decided to stay because he has 15 plus years of experience.  i don't trust him in everything he said but it's hard to change lawyer.  how's your lawyer, is he good?

Here is my case, my lawyer said: the guy drives a 1998 misubisi, he's poor, he probably has a low coverage and we going to take whatever the limit is.  He never talked about my UM coverage which might help with the medical bills. He was never able to find out the guy's policy limit. He said the insurance company doesn't want to let us know.  Until now, i don't know the other guy's policy limit.
I'm stuck now, i think all the money will go to the medical bills and i got nothing but a bulge disc and a pinched nerve.  
i have seen two chriropractors for 4 months, and two month with a pain management specialist who gave me the shots.  I've never seen a Neurology or an orthopedic.  Which doctors have you seen? how helpful were they to you?  I think you're hurting a lot more than i do.  Epidurals should help, but don't always help for everyone.  Surgery, hm, not in my mind.  I heard it's high risk, costs up to 40,000.  I don't know if your insurance covers that.  The lower back carries a lot of weight, it takes times to heal post-surgery and if might got worse after surgery.  YOu should do research on it.  Also, lawyers usaully dont take Lien for surgery, it's a lot of money they afraid of.

So, do you know the policy's limits, do you know the max of money you can get to cover the bills, and to compensate for your lost.? Talking about compensation for what we suffer, i don't know how much is enough. do you think about going after the other party's asset for more compensation.  
for me, i don't, my lawyer doesn't want to deal with it, i don't think the guy has any assets. I just wanna get the policy limit, pay the bills, and move on. I'm tired of this.  I suggest you not to settle the case, take them to court if they don't pay you the maximum limit.

Thanks for all that....first of all, my advice to you is to get another attorney if you do not trust this guy. He sounds kinda flaky to me and doesn't seem like he wants to fight for you and "go for it". He shouldn't be assuming the other party's coverage is low and basing your compensation on that. He should be asking for top dollar with confidence in your case and in your injuries and then if he has to move down the scale, at least he tried. He should also want to fight for you 100% and go after the other person's assets if he has them. I actually fired my first attorney because he kept telling me, "you need surgery, go get surgery we can get six figures" - this was long before I even knew I needed surgery. But the thing that bugged me the most was he wouldn't listen to what was most important to me. I had to withdrawal from the Spring semester because I was not able to sit, drive, walk, etc. That is a huge deal to me to have to postpone my graduation. (I was supposed to graduate in 08 and become a teacher). Anyway, I ended up firing this guy and I got another attorney who is going to fight to get me compensation for missing that semester. His argument will be that I deserve the money I would have made as a teacher had I graduated on schedule. You see, he is willing to do what is important to me and is not afraid to go outside on the regular insurance policy numbers. He collected all of my paperwork from the other attorney, sent him a letter telling the other attorney not to contact me further, etc.

If you did not see a neurologist, how do you know you have a pinched nerve? Was that found thru your MRI? Did you have an EMG?  To answer your question, I had physical therapy for 6 months, saw my general physician, and a neurologist. I cannot tolerate the pressure on my back from a chiropractor.  

I am not afraid of surgery because there is a noninvasive surgical procedure to relieve the pinched nerve, the recovery time is only 3-5 weeks maximum, in some cases it takes less time. I will only do this if the epidurals do not work. I am using my private insurance to pay for all my bills. I do not have medical insurance thru my car insurance. So,what happens is, Blue Cross pays for everything except my copays and then they will want all their money back from the other party's car insurance (they will have to fetch that on their own).

Don't get too down, remember nerves take a long time to heal. It doesn't mean this is a permanent situation you are in. You can get stronger and do most things you were able to do before in time. Don't give up. Also, just because the guy has 15 years as an attorney does NOT mean he has 15 GOOD years. He may just suck and if you are apprehensive about him, get another one - it will be worth it.

Hey there, i think you're right that my lawyer doesn't wanna really fight 100% for for my case.  Maybe he doesn't have the ability to fight in court, or personal injuries might not be his expertise.  I should have fire him long ago and get another one.  

I'm glad that you've found a lawyer who's willing to fight for your case.  if you were not hit by a driver, then you would probably on your way to graduatin and become a teacher. Now that you had to quit school because of the injury.  You told me that now you're able to bike on the stationary bike, How's your sitting, walking and standing for you now. I hope you're doing better.

My Pain Management doctor says that i have a nerve pinch from looking at the MRI report and the shooting pain that i have down my right leg.  what is an EMG?
oh, i think you have a better knowledge about surgery than i do.  If you plan to have surgery then make sure you choose the right surgeon.  I've heard about laser surgery, i dont know if that will work for you?  I hope the epidural shots will relieve the pain for you.  Are you about to get the epidurals soon?  I had three of them, each epidural is two or three weeks apart from each other.  

I didn't tell you how the accident really happened. I was driving on the freeway in morning, heavy traffic. The guy infront of me suddenly stopped completely, then i came to a complete stop but guy behind me was going to fast, he couldn't stop so he hit my car and my car slided forward hit the rear of the car infront of me.  The guy behind me is at fault and is responsible for everything.  Right after the accident, the guy from behind walked up and told me that he was looking else where and when he saw my car, it was too late. There were no blood so i thought i was ok, didn't go to emergency room.  I went home and felt something wrong on my lower back.  It costed about $9K to fix my toyota corrola. Insurrance paid for it.  For the last year, i had lot of bad lucks, i dont know why but things are not going my way.   Except for my gf, she's very supportive of me.  

I heard that the law allows us only two years to settle the case, is that right?  they say the case should not last more than two years beginning from the date of the accident.

It would be worth it for you to seek out another attorney - you are under no obligation to this one (did he take a retainer fee or any monies upfront?) And, yes, you have two years in which to file a claim.

I can only bike on occasion, my back does not always allow me to. Sitting is getting a little better (but I do very little of it).  I don't drive hardly at all (sitting in that position is painful) and standing up and walking are also a challenge. I am slowly getting better, but that is only because I have been "watching it" - but I am not willing to keep living this way, I don't want to have to watch it and should not be expected to. Some days standing is easier than other days, but I walk funny. It's like I walk like a pregnant woman. I feel like I look like an old man, when I am a healthy, fit gal underneath this stupid injury! LOL  When I don't have the weakness, things are so much better but it doesn't last for long.

The injections begin next week, I am wondering if they are going to help at this point. It has been 9 months since the crash. I feel they will be a bandaid and I will think I am OK and think mess myself up. How soon after your crash did you get the injections?

An EMG is a nerve conduction test. Tiny needles are inserted in certain areas of your body and you get mini electrodes that shock you - the doctor measures the speed of your nerve reaction to the stimulus and tells him exactly where your nerve is pinched. My MRI did not show the impingement, but the EMG clearly did.

That sucks about your accident. Did you look in your rearview mirror and pray? That must have been scary. I never saw the bia who hit me. That is good your girlfriend is supportive of you, that is so important. I have a couple close friends who are there for me as well. Sometimes I wish I had a bf to take care of me and then other times I think I am glad I don't have a bf because I wouldn't be a very good gf in my condition. We couldn't go out or have sex LOL...

For my lawyer, no i didn't pay any monies upfront.  and i believe that i have no obligation to the lawyer.  

mh, i can imagine how tough it is for you to go through all this.  But don't worry so much, it will heal with time and you will be fine.  Just put your mind together and do what's good for you now. Your family will help you through this time of toughness.  Besides that, u got me here. I might be far from where you live, but this site will help keep us in touch.  =)

Hey, i remember about six months ago, one day i did a little jumb shoot with the basketball and that night i had bit of pain on the lower back.  The morning after i woked up was worse, my back was so tight with a lot  of pain, i couldn't even move.  i had lot of pain standing, walking, the worse pain i ever had.  My cousin took me to a doctor and i got a shot.  I went home, and surprisingly it healed fast, the next day i was back to normal.  Eversince, i avoid rough activity and lifting heavy objects.

Epidurals basically relieve the inflammation and the tension on the nerve, so i think i will help.  When i was getting the shot at the doctor's office, i had a chance to talk to some older people.  They said it helped everytime they got it.  I got the injection about 7 months after the crash.  

and yeah, i did look at the rearview mirror and saw it was coming, a white pickup truck.  I held on tight to the steering wheel, and bangged.............crash.  I got some pain now, i'm gonna rest.

Hey there!

Thanks for the words of encouragement LOL.... I know it will all get better, just some days are worse than others, you know?  It is nice to be able to chat with someone who totally understands instead of people who try to imagine.

I know the epidurals help with inflammation,etc, but it's hard to believe I still have the inflammation after 9 months. I was on complete bedrest per my doctors orders and because I had no other choice, I was taking antiinflammatories like Ibuprofen and Naproxen, not to mention Flexeril and Vicodin. You would think the pills and bedrest would have knocked out the inflammation. We shall see how the shots go, I am very hopeful!

Do you take any painkillers anymore? How many were you taking prior to the shots?

I was wondering about how we are to settle our car cases because we really don't know whether we will continue to need injections or surgery or further medical care in the future. Just like you said, playing a little innocent B-Ball and you were knocked outta whack again. What if you were just bending over to get something or were making the bed and kaboom? I believe we can get some sort of compensation for the pain and suffering and anticipated medical care we may need in the future. I am going to find out about that next time I talk to my attorney.

Hope you have a nice weekend. I don't mean to be pessimistic, but everyday is pretty much the same as the one before. I can't count on myself to keep plans so I don't make them. I have missed a lot of ball games that I would have gone to if I was able. Anyway, things will get better and I will come back better than ever!!

For me, i liked them.  They felt like a bee sting.  
The first one helped me a lot but the one after....hm....didn't help much......

Painkillers? i dont take them. I dont know if they actually help much, and i heard that painkillers are bad for the liver especially the strong ones, So i dont take them.  
Hm............i like it when it hurts, baby..........hahah
I know you have taken them, did they helped you a lot?

I usually start the day without pain and at noon i would develop some tingling on the right leg, and if i do a lot of walking, sitting then it would get worse in the evening.  Taking a nap, whenever i can, helps it a lot.......

I know what you're talking about.  They should compensate us for the anticipated medical care we will need in the future.  I've been telling my lawyer that he neeeds to get me some money so i  can pay for my medical care and doctor visits for years to come.  My lawyer was never able to find out how much the guy's policy carries. how about you, did your lawyer find that out for you?  
I was calling my lawyer today to find out where the case is at but he's on vacation....what the heck....i hate lawyers, most of them....not gonna marry one, never.....but teachers are fine......heheh

My weekend was good, sunday was better.  I had coffee in the morning, played video games in the afternoon, and in the evening i went to a bar for a drink and some food, good food........I didn't get drunk when i left the bar.....never had a DUI....LOL

I know most of your days are the same since you dont get to do what you really want to, but try to relax and enjoy as much as you can.....You know like, thinking about one day that you will be stronger, happyier, be able to do what you once did,  and feel like it's the old you that has come back................and think about me too.........heheh.

This is what helped me and seems similar to your symtoms (symptoms).  I posted this elsewhere on this website and hopefully it will help you too:

I am a 43 year old male who had very bad sciatica 3 years ago for 2 months, then mild for another 4 months.  I went to the chiro, got xrays, diagnosed with sciatica, spondyliothesis.  Got MRI, confirmed the same, and showed disc bulges at L4 and L5 too.  

I had chiro adjustments for a while.  I went once to a back-decompression center, but couldn't afford the $2500 for a month of decompression therapy.  So I incorporated the decompression in my workouts.  I would hang at the gym from a "preacher chair" and from the pull-up bar repeatedly before and after my 2 hour mild workouts (2-3 times before and after for a minute for each hang).  It was the only thing that ever gave me any relief at all from the pain going down my butt, leg, and to my big toe.  It stretches the spasming muscles, ligaments, releases pressure on the discs, and pulls the slipping spine back up and straight).  Doing it repeatedly also pulls fluid back into the discs to help rejuvenate them (discs have no veins to supply fluid so they need movement to push fluids into them to keep them pliable).  I also leaned over my kitchen counter, bent my knees and let my legs hang several more times a day whenever the pain grew bad (or I leaned against the counter and turned my hands backwards on the edge and did a push up and locked out my elbows above the counter (anything to unweight/decompress the spine multiple times a day).  I also lost weight and strengthened my abs on the ab-roller type bench at the gym, and did back strengthening exercises as well.  I think the decompression was the most beneficial thing and helped heal my back.  Even though I have read that 80/90% of these sciatica pain issues go away on their own after a few months, I still believe that multiple decompression helps heal and keep spine healthy, so I still do it once before and after my workouts today...3 years later.  If you can afford the $2500 back decompression center costs, I would suggest to try that first before major surgery.  I am still doing good now and keeping my fingers crossed.  Good luck to you all and let me know how this works for you.

Hey there!

The shots begin this Friday - thanks for the bee sting analogy! LOL... I went for a consultation yesterday. The doctor is not very hopeful they will work because it has been a long time since my injury, but we shall see. I found out that the muscles in my right leg have atrophied because I am not able to use them or put pressure on them because the pain is too severe  : (   so now I have another problem LOL....but the great news is that this Pain Center also has a cool rehabilitation center that can help me out with aggressive treatment to get my muscles back!  YeeHaw!!!  
The shots cost $4,500-5,000 a pop!  I had no idea. Oh well, all of the money I put in for them will be returned to me when I get my settlement.

I am not usually one for painkillers or any pills for that matter, but there is no way in Hell I could tolerate this pain on my own. The pills can cause liver problems only if you abuse them. It's the acetemetaphen in the pill that can be toxic if you overuse it. I am very cautious and don't overdo it.

Dude, you need to fire that cracker of a lawyer you have LOL....he sounds flaky. May I ask you what the limit is in your insurance policy? Do you have the minimal coverage? When do you think you'll be ready to settle?

It's refreshing to know you had this problem and now are out doing stuff - your weekend sounded fun. I want my social life back so badly!  And you better NEVER drink and drive otherwise you will find yourself at the other end of a lawsuit yourself!  I haven't drank alcohol at all since the crash because I am taken the drugs LOL.

Thanks for sharing your story.  I have gone through several months of physical therapy, including traction, to no avail. Sometimes a more aggressive treatment is necessary.  And trust me, nobody wants surgery less than I do! LOL

My sister has one of those things you lay upside down on and she does get relief from that. However, she is overweight and really should also incorporate other physical activities into her lifestyle. I can definitely see how using that contraption works by relieving the pressure, I wish it worked for me!!

My nerve is stubbornly pinched and nothing I have tried has worked so far. There is a minimally invasion surgery that can be done if the injections do not help. I will cross that bridge when I come to it.

I am very happy you are feeling better and have your life back. I am looking forward to living a full functional and productive and ACTIVE life once again. I will get there!

I haven't posted lately because i was busy with my job...
Anyways, my condition is that i'm still living a full functional life dealing with the pain i have.  One day the pain is worse than another.  It's tough on the job when having a back pain like i do...Even siting is uncomfortable....Even though i'm enjoying it, life sometimes sucks, it's unfair, why do we have to suffer like this, the nerve pinching thing is making our lives miserable.  what will the future hold on me.  
to answer your questions.  My policy coverage at the time of accident was 25K/50K.  MY uninsured motorist was 15K.  i will see my lawyer this wednesday to decide what to do wtih the case...Most people tell me not to just settle because settlement will not give me the maximum amount i can get.  They say i should take it to court....i think that's what im gonna do....what's your opinion...
For changin the lawyer, its tough for me now because it's been a year and the medical bill is high.  I've talked to other lawyers and they dont really want to take the case.....

about the epidurals...the first one didn't help you, i really dont know if the second will help.  consult with your doctor, i'm sory i cant help much  on this since my condition is not as severe as yours...
be careful, some doctors just want the money...man, i hate doctors too, some of them can be careless about patients. LOL

About your settlement, it is not necessarily true that you will get more money by going to court - it's a case by case thing. IF you do decide to go to court, your attorney will most likely charge you a greater percentage than he is right now. I hired my attorney asking if he would take my case for 28% (attorney fees are always negotiable)...he said, Yes, but if we go to court (which is highly unlikely) he will have to charge me 40%. Just something for u to think bout. Also, because other attorneys are not interested in your case, perhaps that is telling you to settle out of court - 90% of car accident cases are settled out of court with big bucks gained! Good luck to you and please let me know what happens.

hey there,

thank you for giving me some of the tips that i need to know.  
I've just talked to my lawyer today and we decided to file a lawsuit against AAA.  The problem is that the insurance, AAA, hire a group of attorneys to handle these kind of cases including mine and they giving us a hard time.  Since we're not getting the money we wanted, we decided to go to court.  My lawyer said it will takes about 3 months to complete the filing and the court to give us a trial date.  
My medical bill is high too since i got 3 epidurals and 3 months of chiropractor.....I'm hoping that the lawsuit will compensate me with a reasonable price of money.  
That's an update on my case and i will try to post more often...

So are you feeling better with the epidurals,  have you got the second one yet?
Where's your case going, and are you still thinking about sergery (surgery)?
I feel like i really know how it feel like with all this that's happening to you, that is why i want to know
what's goin on with you..........

As a lakers fan, i'm still upset that the gereral manager and the owner didn't to anything to improve the team.  It's so sad to see the lakers lost last season and they will loose again.....unless Jerry Buss bring in some good players.

Why is AAA giving you a hard time? Are they questioning your injuries? What was their offer that you refused and decided to go to court instead? (sorry, you don't have to disclose that if you don't want to). I truly hope you get every penny you deserve!

The epidurals have done nothing for me, unfortunately. They have increased my weakness dramatically and my pain as well. I am also sweating a LOT and can't sleep a wink! Argh!!!  Oh well, at least I tried them! I am looking forward to them getting out of my system. I begin the rigorous rehabilitation program in a few weeks. I will go 5 days a week, 2 hours each day for 8 weeks. The muscles in my right leg have atrophied and need to be built up again. I am excited about the rehab..I know it's gonna hurt, but I really don't want to have surgery. Also, because I have always been very active, I am looking forward to "working out" - although supervised - and they will totally work me out!

Sorry you're bummed about the Lakers...I am a total baseball and football fan myself. I have lived in Cali my whole life but love the Packers! I went to Lambeau field last year to watch them play the Vikings...it was so exciting. We left S.F wearing tank tops and landed in the snow....talk about an AWAKENING!!  

Keep me posted on your case please. Mine is still in the making because I have a long way to go yet in my recovery. I did find out though that you have 2 years to file a claim, but you don't actually have to settle at that point - you know? A lot of people get ancy and want some green backs though!

How are you doing otherwise? Do you feel you have made a complete recovery? Do you trust your attorney now?

AAA only offer enough to pay for medical bills so we decided to go to court.  I hope the policy limit is high so i can get some money.  Otherwise, that guy is responsible for my compensation.  

How is your leg doing.  have you started the rehailitation program yet.  I hope it work well for you.

I got a bad news, my friend Tony has just pasted away a few days.  He was  my co-worker and my good friend.  He so young, 23, very nice and easy going.  He slept and never wake up...I still remember everyday we used to go out for lunch together and now he's gone.  Life is so short huh...anything can happen...

To Answer your question, i'm feeling ok, i guesss the epidurals help me a lot and it still does.  I dont think i will ever make a complete recovery, once the nerve is pinched it will always be pinch unless i have surgery.  I try to do some exercise and stretching hoping it wont get worse.  I'll be happy if it stays like this for years.  I still have some pain but i cant complain.  

I think i trust my attorney now, last time i saw him we had a conference call between him, me and AAA lawyer.  I heard everything that they said.

I am so sorry about your friend, what a terrible blow. That must be so hard for you. Only 23? Geez, did they know what exactly happened to him? That is just awful, I wish you the peace and comfort you need from God to help you through this loss.
So, you are going to court, huh? I hope that all works out for you. Did your attorney say how long he expects the case to last? Did he tell you your chances? Also, does he have a set number in mind that you will agree to? I am glad you are trusting of your attorney now, that is a big relief.
I have not started rehab, unfortunately I had a very bad reaction to the 2nd epidural. It ended up making me much worse where I could not walk for 10 days. The pain was outta control! I went to an orthopaedic surgeon and he ordered another MRI. I go back to him tomorrow for the results of that MRI and he will tell me what he can do for me. He told me that a lot of people come to him and he turns them away telling them he cannot do anything for them. But, luckily, he did not do that to me. I obviously cannot go on like this - my activites are seriously restricted.

hey there,

It's been a while since we talked huh.  There are some new things about the case that i want to let you know.  Finally, triple A disclosured the policy limit.  100K is the max that we can get for my case.  I saw my lawyer yesterday and i heard his conversation with AAA's new adjuster, since the speakerphone was on.  They promised to give us an offer next week, so we'll just wait and see how much the offer will be.  
My lawyer said that he prefers to have the case settle with a fair amount of money.  He also said that it would cost lots of money and time if we want to go to court since we would have to hire a neurologist to go and testify, plus other cost too.  Do you agree with what he said?  
My medical bills come around 17K to 22K since i got three epidurals and couples of chriropractors plus MRI/Xrays.  When i first came to the lawyer i agreed to a fifty fifty deal after all medical bills are paid.  At what price of the offer you think i should settle with?  I dont want to go after the other guy, he seems to be a nice guy and it was just an Accident.  I just want to get the max out of the limit.  It's a big relief for me since i trust my attorney more and i got a better ideas on where my case are going.  Give me your opinions on this and on how i should proceed with the case.
  
and about you, how are doing? i heard that you got a nerve blocking shot or something like that, and you are considering surgery.  It must be a tought decision for you to make.  I hope you will do well, get much better.  Let me know how things going for you.

Wow, sounds like your case is coming along. I cannot give you advice about the money thing right now as I am on drugs! LOL....
I did have surgery four days ago and feel GREAT! I had a large annular tear and ruptured disc fragments removed. I woke up with NO LEG PAIN and am feeling FINE!!
I will be back online in a day or so - am a little sore right now. I would love to find out what happens with your case.

p.s. not sure what you mean that you agreed to a 50/50 deal with your lawyer? Does that mean you want him to get 50% of your settlement money? Sounds WAY too much - he didn't suffer, you did all the suffering! I am paying my attorney 28%, I should have went for 25%, but it's ok.

hey, it's great to hear that you're feeling fine after the surgery.  I hope you keep getting better.  

yeah, we will use the settlement money to pay the bills first, which is somewhere about 20000, then the rest will split in half between him and me.  I agree with you, it's too much of a deal and i'm the one who suffer the most.  The only risk that he took was that, if the guy's policy limit was 15000, then nobody will get any money because it's all go to the medical bills.  but that's not the cenerio here, the limit is 100K.

for me i dont have insurance of any kind, so all my medical bills were signed with Lien from me and my lawyer.  I think yours is a lot easier since you have your own medical insurance.

does your case go the same way like mine but instead of a fifty fifty deal, you only pay your lawyer 28% after the medical bills are paid.

Hi -

If the guy had only a 15K policy and your bills exceeded that amount, you can turn around and collect the remainder from your own insurance company. It's called having Underinsured coverage. My insurance policy is 100K/300K and if the other party only carries a 15K policy, I have no problem whatsoever collecting the remainder from my own insurance company - that's what I pay them for.

Your attorney taking 50% of YOUR pain and suffering is outrageous!

What will happen in my case is that my own private insurance (Blue Cross) will turn around and collect every penny from the party who hit me. I have paid over $20K in copays (not counting surgery bill yet). I will get back all of my copays and Blue Cross will get back what they put in which is only fair. Obviously, my attorney is entitled to no part of my medical bill compensation and will only be allowed to take 28% of my personal pain and suffering money.

When do you think you will settle up? I must say, no amount of money is worth the year of my life that I lost - it's precious time that I will never get back. It's been quite an experience and one I hope not to have to do again! LOL

How are you feeling? Still having problems? I feel so good since having the surgery - now all I have to do is finish recovering, go to physical therapy and I will be back out in the world! I miss school and working. I can finally see the light at the end of the tunnel and it is calling my name!!!

I was rear ended last year By a driver who was not watching the road and possibly Tex messaging I have a ruptured L 4 /5 in my back plus neck pain, headaches,ear ringing, jaw pain. pain in my middle back and R leg numbness. two weeks ago I had to take a 3 hour trip for an independent medical exam for there insurance company. it was very snowy ruff road pot holes.30 miles an hour.By the time I got back I had developed pain in my neck, middle back bad headaches.at first it was not too back as the days went by it got to the point to where I was in agonizing pain I could not take a deep breath and every time I turned or moved it would spasm.It dropped me to my knees.I went to the ER they of course could not help and sent me home with pain med and a shot of demurral. It only made me nauseous.I went to go see my regular doc.All he could say is He recommended that I go see the my Orthopedic Dr. I told him that he cannot do anything other then  surgery.He did give me a RX for anti inflammatory s which the hospital  should have done and then just kind of put me off.He was in such a hurry to leave and said you did not schedule in this appointment for back pain..What is wrong with doctors now days especially after you are in an accident and going through hell with a law suit and trying to have a half way normal life without pain. I'm sure no one has the answer I just wish we had the medial and insurance company's like they had in the 60s.They treated you good.
