6yr old-disruptive at school

My 6 year old is going through his 2nd year of kindergarten.  He's an August baby, so he was a little younger than the other kids last year.  The school promoted him to the first grade, but we decided we wanted to hold him back.  His academics were okay, but his behavior was where we had issues.  During story time, he will not sit still and start touching the other kids.  Not hitting, pinching or anything like that, just touching.  He can be loud and often doesn't listen.  The teacher has to give him multiple reminders.  He's not physically or mentally abusive.  By this I mean he doesn't hit kids, call names or destroy or break anything.  His behavior is just disruptive to the class.  The teacher's have never mentioned anything about ADHD, so I have not been worried about that.  He will do normal things like watch TV and color for quite some time without being "hyper".  His teacher has started doing a daily behavior report.  Out of 7 smiley faces a day, he usually gets 5 to 7.  We have a parent teacher conference next week, so we will be able to discuss that more with his teacher.  If he gets one sad face, we let that slide.  If he gets two sad faces, we take away his games.  Three sad faces, he loses his TV and games.  Does this seem sufficient?  When he has has no sad faces, we do get him a treat.  I have a friend who was talking about the gluten free diet.  Should I try this?  Please respond, thank you.

Unless he has digestive disorders,  a gluten free diet wouldn't be of any help.

I don't understand what the problem is here - can you elaborate?  He keeps up academically,  and in fact did that last year before he was held back.

He gets 5 - 7 smiley faces every day out of a total possible 7.  

You have the teacher conference next week - if his behavior is actually a problem,  she needs to be indicating that to you.  5-7 out of a possible 7 is not communicating a problem to you.  That's communicating he's doing okay.
