Inappropriate Touching

My now 10 year old daughter was sexually assualted by two boys 7 and 12. I have been told by the police that this is just inappropriate touching, The 12 year old had the 7 year old pull my daughter's clothes off and press his penis next to my daughter's vagina, not to mention that they licked her from top to bottom, front and back and put their tongues into her mouth. The oldest boy told her that if the younger one or my daughter told, then he would beat both of them up. What do I do? My daughter is in counseling and has been from the beginning. I also took my daughter to a doctor where they found bruising, and swelling.

If you can afford a lawyer, hire one. Even if the police won't do anything, you can sue the boys in a civil court. You might have a case for assault, battery, or intentional infliction of emotional distress among other things. Only a lawyer can tell you for sure.   A lawsuit won't give them a criminal record but it will send a strong message to the boys and their parents.  However, it also means that your daughter would probably have to testify in court so you should also talk to her counselor to see if this would be too hard for her.

I can't get your story out of my mind.  My heart goes out to you and your daughter.  Where did this incident happen?  If child care workers were supposed to be monitoring, you can press charges against the facility.  Either way, uou may also wish to contact CPS, because the children's behavior is far beyond what they should know at their age.  It also sounds like the 12 year old is the "mastermind" in this case.  It really sounds like the 7 year old was a victim here too.

Did you contact the police after the doctor found bruising and swelling?  This may change their verdict.

I'm sorry, I'm trying to understand this whole ordeal.  Was there a weapon involved?  Why else would your daughter let them do this to her?
