My son the clown

My nine year old has recently started getting in trouble at school for being silly. He has always been very smart, but now he has started acting out. His father was in a car accident last May and he was home for seven months due to his injuries. Recently we have started our own bussiness and my husband has returned to work. Twelve hour days seven days a week. Our son spends little time with him. Could this be the reason he is looking for attention? What can we do to help him?
