We found out it was the teacher but that was not the only reason she called she also called cuz I have my kids layer there cloths due to the fact its only been in the teens and they walk but any way thank you for your imput and  I am going to talk to the teacher about the bathroom policies and also try to explain the situation family services did not find anything wrong thank god and our taking our side and had said tha there is nothing they can do because it just might be a way for him to protect him self and keep the bullies away if that makes any sense to you. Thank you for your help.

Another thing to consider is that many times kids don't want to use the school restrooms during lunch or recess due to the other children in there.  If you have a teacher that refuses to let a child go during the class period, then the child will hold it until its too late.
I would ask your son what the teachers policies are about going to the restroom during class time (be aware, the teacher might allow it, but make it so embarrassing that the child  feels uncomfortable going).  I would also ask one of his classmates the same question (if you know them or their parents well enough).  I would also ask the teacher what the policy is. If you can't get a satisfactory answer, I would visit the room to see for yourself what is going on.  Having taught at and been an elementary school principal for years, the above scene would not suprise me.  And, of course, it could be something else going on at school.  The bullying issue could have been enough to have kept him away from the restrooms for example.  In fact, the bullying issue might be something worth using to talk to his classroom teacher about and bring up the soiling issue.  And if your son went to the same school last year, its pretty easy to prove that this was not a problem until this year.
I am amazed that the school would call family services for something that was happening at school.  If you can figure out what is happening, I would make sure that the principal is aware of this and that this is forwarded to the family services.  I am also curious as to who called them in - the school nurse? the principal? the teacher?  Best wishes!

Is he soiling himself at both home and school, or mainly at school?  What happens over the summer?  Did it start before school started or only after the school year started?
