I am guessing that your child will indeed qualify for services because his academic performance is behind and he is being compared to a kindergartener. Usually academic performance is the important factor to an IEP. If the work is hard, perhaps extra help will get him up to speed. I have a dear friend whose kindergarten age son was having trouble with various academic things. She hired a tutor and he is now doing great. so, be open to extra help. good luck!

Not every child who does poorly at school is suffering from ADHD. He may just be poorly organized, which would make everything more difficult and time-consuming for him. One of my daughters works with this kind of problem. The children she trains do not have ADHD.
What kind of works he usually refuses to do? What time? Any pattern? My son has exactly same issue on the summmer before first grade. He was in an academic kind of summer camp which they learned and did works in the morning and had fun in the afternoon. They have certified teacher to teach and ratio is 1 to 6. The teacher told me the same thing. He did not want to do it because he said it's hard. Even teacher offerred to sit with him and teach him one by one, he still did not want to do it either or he can only handle it for 15 minutes and wanted to quit. Later on, they told me that they downgraded the worksheet level to let him do kindergarten works as review and he was able to handle it so fast, After gaining confidence, then they gradually started to throw in some first grade works in between and he is able to accept and do it.
