We know so much today the harm that can be done by tobacco smoke. When I see a parent puffing away with the windows closed on the car I want to scream child abuse. Either these people are truly not educated to understand the damage they are doing to the child or just don't give a rip.
I won't drive with even one drink either. I probably wouldn't blow over legally, but I am one of those who is affected even by one drink and I know it. It's just not worth the risk to me, especially if our son is in the car.

Being A Smoker myself, I still think it is a good ideal. A Child's system is still forming, growing, and maturing and they do not need to be exposed to the effects of second hand smoke. An adult that is around second hand smoke has the option to say something to the smoker, or walk away from it, but a child stuck in a vehicle strapped in a car seat doesn't have that option. Brenda

Personally I think it should be 0 alcohol for anyone who is driving.
As some people here know I am an alcoholic in recovery,but even when I was actively using alcohol I wouldn't drive even if I'd had one drink,not that it would ever stop at 1 drink lol.I was lucky in the respect my husband did all the driving when we went out.
I don't honestly know what I would have done if I didn't have my husband to rely on.
And I'm glad I've never had to find out.
Everytime you post something about the laws or life in Australia, I am amazed at the similarities...it's exactly as you described here too. Unfortunately they still don't get enough of the drunk drivers in my opinion. And I would love to see heftier sentences, although the 0 tolerance for provisional drivers is a big step in the right direction. Oh, and here the blood alcohol limit is .08, but I think they are working on lowering that.
It is a lot harder in Australia to get away with drink driving,we have Random Breath Tests,we call them booze buses.
They set up and pull over random drivers to be tested,they might test up to a thousand drivers during a stint,if you are over the limit you are taken to a police station and charged with a DUI,(Driving Under the Influence).
If you are a provisional driver(which means you've had your licence less than 3 years the blood alcohol limit is 0,for everyone else the limit is 0.05,that is equal to about 2 standard drinks,depending on the individual person the amounts could be less.
The random testing is often set up at night down the road from bars and clubs at closing time,I think this is a great idea and they catch many offenders this way.
Kay, such a good point. It's like drinking and driving...it probably is easy to get away with it, but it is so socially unacceptable now that most people don't do it. Awareness over the danger of it is high. It is so unhealthy to smoke around children. Public pressure to not do it is a good thing. I am not anti smokers...that would make me a hypocrite. But there is a time and place, and smoking in a home with children or a car with children is so unhealthy for them.
Our local news had some interesting stats last night on childhood asthma...it is way way down. Dr.s are crediting that to people no longer smoking around their children. I have friends that smoke, and I will admit I still have the odd cigarette, especially when I am stressed. But visitors to my house know outside is the only place and you know, no one ever ever complains about it. Even in our super cold weather. It wouldn't even occur to them to smoke in my house where a child is present. In fact, I don't think I know anyone anymore who smokes inside their home.
I'm all for this law. Enforceable or not---------- it publicly tells people that this is not alright. And if you pull up next to someone while with your kids and smoking . . . you may not get a ticket but you will get a dirty look-------------- it becomes socially unacceptable. And this is the first step to people not wanting to do it.
And the difference I see in comparing this to a car load of illegals is that you can clearly see if someone is smoking and have kids in the car verses just looking at someone and knowing they are illegal. That makes this law easier to enforce in my opinion. And what is that old adage, two wrongs don't make a right?
Well, I see your point, but this is a Canadian law, and it's a bit different here. We don't really have much of a problem with illegal aliens or terrorists. Heck, the vast majority don't even own a gun...although you might catch lots with marijuana..lol.
I do wonder how it will be enforced though...check points? haha.
LOL.... I got the stretch, el. I am with you. I think smoking in the presence of a child is certainly an issue.... but there are things that are slightly more enforcable that arent being enforced.
The next thing I thought of was terrorist activity. Between what you mentioned in the stretch and the terrorists...... political correctness is doing what it does best. Dissallows anyone to do their jobs to the best of their ability.
What a time and place to be alive! If there is an afterlife where we can sit down and chat with the others, it would be fun to compare notw with folks from 100 years ago....

I'm more than fine with a law prohibiting smoking in a vehicle when there's a minor present, but I'd like to see them try and enforce this. We obviously can't be trusted to parent our own children without lawmaker & government intervention, so I'm happy to see stuff like this on the front page, but it opens up a very large can of worms.
Like I said, if you're an illegal alien and driving around, it's okay and we can't do anything about it (or even ask your residency status for that matter), but toss a kid and a pack of smokes into the mix, and that's somehow more enforceable than the fact that you're breaking immigration laws?

I think the laws are good,the only problem is policing it.
I'm not sure about the US but in Australia our police force is already stretched to the limit,can it be justified to take police away from more immediate life threatening situations.
I agree. Even as a former smoker who admittedly "cheats" sometimes, I never have nor ever would smoke around a child. You still see it all the time though..people driving down the street, kids in car and lighting up. I too am glad to see laws like this. Of course, some are screaming that it is the loss of a freedom, but most seem to be ok with it.
I am totally for this type of law. People who smoke in cars with children are not thinking about their children at all, they are showing complete irresponsibility, and someone has to protect these children: the government.
I am always disgusted when I see adults smoking next to children.
