WASHINGTON (AP) — The Supreme Court says an anonymous tip can be sufficient to justify a decision by police to pull a car over on suspicion of reckless or drunken driving.
The justices voted 5-4 Tuesday to uphold a traffic stop in northern California in which officers subsequently found marijuana in the vehicle. The officers themselves did not see any evidence of reckless driving.
Justice Clarence Thomas said the tip phoned in to 911 that a Ford pickup truck had run the caller off the road was sufficiently reliable to allow for the traffic stop without violating the driver’s constitutional rights.
Justice Antonin Scalia wrote the dissent in which he called Thomas’ opinion “a freedom-destroying cocktail.”

What a waste of the Court’s time. I am surprised it was 5-4 (I shouldn’t be, considering this group of clowns). Once the 911 call was made, it is considered “Probable Cause”.

Private Security has its place. Here they usually work well with and are respected by Law Enforcement  but we also have those Rogue, Want-a-be, Rent-a-Cops. I find that most of them couldn’t get a job being a cop so this is the closest they can get to fulfilling their dream. They don’t make it long before they are weeded out.

Interesting... I've got mixed emotions on this one as well. I've called in REDDI reports while being behind someone who is all over the road.  I know for sure that 3/4 of these calls have resulted in arrests.  I'm not sorry about that either.

I do understand the "freedom" issue at stake.  I'm not hiding anything, nor am I running narcotics or doing anything illegal.  I have been pulled over for the "suspicion of driving drunk".  I was asked to perform a road side sobriety test and breath-a-lyzer and even offered up my own blood to clear my name.  (I got off, because I wasn't drunk.)

Here's what gets me.  At the time I got pulled over, I was running a nightclub/saloon.  We had a 'security firm" in town that liked to listen to the scanner and try to beat cops to certain calls, and on occasion we had to call the cops because of an unruly customer.  This particular night we called and a rent a cop showed up and escalated the situation.

I told this guy to get lost and informed him that nobody needed his assistance.  He got mouthy with me and I told him that it would behoove him to remove himself from this situation.  He took that as a threat.  After we closed down for the night, I went to the convenience store to grab a Gatorade.  When I got there, the very same rent a cop was there and he was giving me the stink eye.... so, me being the young guy I was, I flipped him off.  He in turn called the cops with my license plate #, physical description and told them that he thought I was wasted.

Long story short, a cop pulled me over right after I left the convenience store.  Asked me if I had been drinking and told me that he "smelled a strong sense of alcohol" coming from my person.  I politely told the cop that it was likely impossible because I had not been drinking, but it was potentially possible because I work in a bar and we had a big fight (which is where the rent a cop showed up in the first place).  The cop asked me if I would perform a sobriety test, which I agreed.  I told him that I would give blood because the hospital was on the way home.  The cop asked if there was anything in my truck that he needed to be aware of.  I informed him that my pistol was on the console.  He asked what kind, if it were loaded and asked why I was carrying it......

I was not arrested.  I informed him that I knew who called and said that the kid was mad because I called him a rent a cop and told him to get his nose out of my business (at the bar) and that I ran into him at the convenience store and flipped him off....  I told the cop that I would be speaking to my attorney about the situation.  

My attorney spoke to the Chief of Police, a woman I knew rather well.  He also spoke with the rent a cop agency and told them that they were not obligated to respond to any calls outside their client list, and if any of them ever showed up at my bar for a call, there would be trespassing issues among other things that they would need to address.

So, if I were running pot or something I could have been in a real pinch and I would have probably felt like my rights were being violated.  Maybe its just me, but I wanted that cop to check my vehicle and see that I was on the up and up, and that his informant was a P.O.S.  Point conveyed, and I later got to beat the **** out of the rent a cop when he started a fight in my bar...with me.

Win/win situation.
