NY Laws and regulations on controlled substances for refills. Schedule II.

Okay. This is for anyone who is AWARE of the laws and regulations for refilling a controlled substance. Apparently, I was told on February 1st, 2010 the Medical Center where my Dr. is has changed their policy on refills. It used to be every 3 months, but now patients must be seen every month in order to receive their "30 day supply". I'm told that as long as a patient is seen by their Dr. in the month their prescription will run out, the Dr. will Write them a prescription which will be "POST-DATED"(which has always been done anyways). I am also told that their new policy for refills...must be written for the same day as the previous month; like if it was written on Feb. 15th, the next one would have to be on March 15th. I just don't understand b/c from my research on this subject, I have found that "POST DATING" or "PREDATING" prescriptions for controlled subtances is ILLEGAL. Also I have found that the NYS law is that you may obtain a perscription as long as it's date is at least 7 days from when the previous supply is gone. Can someone PLEASE advise me on what the law is and if my Dr.'s office isn't following the correct NYS laws and regulations. Thank you!

Don't know NY law, but I'd guess this isn't true because insurance just won't pay for a pscyhiatric appointment every month.  Most plans are 15 minutes every three months.  So unless NY has ordered insurance companies to allow psychiatrists to actually see their patients often enough and long enough to actually treat them, which is unlikely, I'd say this sounds suspicious.  But the only way to find out is to call the municipal government and ask.
