ADA changes effective Jan. 1

"ADA Amendments Act Takes Effect Jan. 1:
Get Ready For New Challenges"
it changes the language requiring  an aliment to impede a major life activity and there is an amendment on the exsisting law anad result in an expansion of who can be classified as "disabled".

Be advised of the upcoming changes.....

Thankyou forall your input.  I just was classified as permanently disabled from job of injury.  I also have numerous disability ratings from those injuries.  Will just have to play it by ear and one day at a time.

This will not help u get disability, but how they classify who and how someone is classified as disabled has changed with this bill.And because of it , more of us should have a easier time proving we r disabled.

U need to go thru SSI or SSID...or ur LTD insurance comp.

The whole point as to y this was important is they opened up the def of who/how someone is deemed disabled.

I hope that clears up this thread and it's content.

Hello everyone!  This post really got my attention as I am on my 3rd appeal with SS and will be up for my permenant review with LTD this fall.  I was excited that a new bill would possibly help me with my two disability appeal/reviews.  I started to research the new Ammendment and even e-mailed an Advocacy group for more information and wanted to share with you what I found out.  So....here we go!  8-)

This is my e-mail to the Advocacy group:  
Hello...please reply back to let me know how the new ADA Ammendment effective 1/1/09 will help people that have already filed and are awaiting disability prior to this bill going into effect.  Everything I have read says that it will only help someone that is filing for disability on or after 1/1/09.  Is there an additional ammendment that will help out the folks that have been waiting years to get their disability???  Thanks so much!!  Wendy

This is their response:  

Ms. Tucker --
The Americans with Disabilities Act (ADA) is a law that prohibits  
discrimination on the basis of disability and requires equal  
opportunity in employment, state and local government programs, and  
public accommodations.

The ADA is not a disability benefit program.  The ADA is not related  
to disability benefit programs, such as Social Security.  
Qualification for disability benefits is not governed by the ADA.  The  
ADA and the ADA Amendments Act have no effect on a person's  
application for disability benefits.

I thought this bill was going to HELP US get our disability but I guess I was wrong!  8-(

I am not sure how that would work; getting a pension from what a  employer?....not sure, but am glad to hear that elsewhere u were able to get the finanical support that many of us are working very hard to get!
I have spinal stinosis as well- may I ask what symptoms were u presenting....

Thankyou for that information. I am an American living in Australia, where the laws are different. I am currently on a disability pension in Australia for not only fibromyalgia, but I also have some other illnesses as well. It was the fibromyalgis that I think put me over the line as my Rheumatologist labelled me as a "functional cripple". My spinal stenosis is another great factor for my pension. However I am in the process of doing paper work to claim a pension from USA and would be very interested in what they have to say about it.

I certainly hope so. Those of us who have invisible diseases are often easy targets by not only employers, but even family members as well ! I hate to say it, but it is the truth. = (
