unnecessary nissen fundoplication

A nissen fundoplication was performed on my grandson for signs/symptoms of reflux.  The doctor never consulted with the gastroenterologist, and after the surgery, he continued having problems such as wretching, choking and sometimes would even stop breathing.  He was taken back to the doctor who performed the surgery twice, he just said, there is nothing wrong with him, he is just "going through the motions of reflux, he doesn't know that he doesn't have it anymore"  After his parents insisted on a transfer to another hospital, he finally consulted with the gastroenterologist.  The gastroenterologist said the surgery should have never been performed, he switched his formula to neocate and he has been doing fine ever since.  He had a milk allergy all along and they performed surgery on this tiny baby for no reason.  What can we do?  Do his parents have any legal recourse?

Hi Mandy,

I am new to this forum but I would agree by the looks of it this does not seem to be the place for legal counsel.All I can say is that having a 2yr old daughter myself your question touched me. I think you and your family shoul follow your hearts on this, and remember there are most likely other children under this doctors supervision as well.
