i'm not really seeing "the rape" here…you consented to have sex after he talked you in to it.
REGARDLESS…
you can have a duo test at 4 weeks or an antibody test at 6 weeks. either of these will give you a very good indication of your status. follow up at 3 months for a conclusive result
I don't care if it's not a law,bottom line is you were raped & should have been given the option of having nPEP prescribed.

A police officer that was bitten by a criminal in the UK that was HIV+ was given nPEP immediately.It's not a law but with rapes here in Australia it is almost always prescribed.

nPEP has been given to people that have had protected sex with HIV+ people that have had no risk at all so there are inconsistencies but this case is serious & nPEP should certainly be an option for you.
Post prophylactic treatment is up to you and your doctor.

It was a rape which is a criminal act,any knowledgeable doctor would prescribe nPEP in this situation.
It's not a law in the US that nPEP has to be prescribed. It's at the doctor's disgression .
Go & report him to police,they will make him have an HIV test and then what you need to do is test at 4 weeks with an HIV DUO which is 99% reliable & then a final test at 3 months.In a rape situation you can insist on PEP & they have to prescribe it to you by law in some states,go to the ER right now & ask for it.You need to be examined aswell with a rape kit.All the best.
