Cobra and Medicare

Cobra and Medicare

We live in IL and was layed off. Recieved CORBA info pack from my employer. My spouse is on SSI (years before layoff) but we have not elected medicare part B in the past because employer insurance was better. Questions?
1) Does my Spouse need to start medicare?
2) Can my Spouse be covered by COBRA?
3) Do I need to inform Cobra that she is eligable for medicare?
4) Is my spouse only able to get Cobra til the next enrollment date?
Thank you for any help

Dear hnrgd2,

According to United States Department of Labor website (http://www.dol.gov/ebsa/cobra.html), those who are eligible for other group health coverage (such as a spouse's plan) or Medicare are not eligible for the premium reduction. In other words they can be on the COBRA but won't be eligible to receive the subsidy for the premium. Here are your answers;

1) Does my Spouse need to start Medicare?
If you find the COBRA premium to be too high for your wife without the subsidy, you will have to pursue Medicare.
2) Can my Spouse be covered by COBRA?
Yes, but if your spouse or you are eligible for Medicare then she will not be eligible for the subsidy but can still be on COBRA (You’ll just have to pay for the entire portion for her).
3) Do I need to inform Cobra that she is eligible for Medicare?
Not unless you are trying to take advantage of the subsidy.
4) Is my spouse only able to get Cobra till the next enrollment date?
Your spouse should be able to have COBRA for the full 18 months just no subsidy if he/she is Medicare eligible.

Sincerely,

Amir Mostafaie
