Senior decisions- Discontinuing an ICDefibrillator

I just read through a strain of questions about turning off a defibbrilator in an older gentleman.  I certainly can empathize with you.  My brother, with the blessing and order from my Dad's cardiologist made a similiar decision for my Dad.  My Dad has end stage heart disease and severe dementia.  He signed a living will with his wishes before his mental deterioration.  Since my brother is a nurse, the technician who was performing the defibbrillator turn offwent to the assisted living center instead of having to transport my dad to the cardiologist's office.  After turning off the ICD the tech lowered the pace settings to run a check.  Is this normal procedure???  The center thought that my brother had ordered everything and called the police.  They removed us a gaurdians for my father and turned the defibrillator back on.  None of us are allowed to visit with him without supervision.  He has been hospitalized 3 times since he has been under state's gaurdianship for dehydration, malnutrition, fractured clavicle, congestive Heart failure.  He won't eat for anyone but family members.  
It has now been two months since we have been restricted and today my sister appeals to the judge for gaudianship.  The court appointed attorney for the state has recommended thatshe only get temporary gaurdianship with the same restrictions.  She would only get power of Attorney for my Dad's financial matters- and the way things are going, that won't last long.

So here is my question.  When my brother tells me that it is normal to run the pace check every six months or if the ICD is turned off- Is that the case?  Also, my Father's entire body twitches in time.  I think his pacer is causing this anyway.  His device has been in for about 6 years now- How much longer will it go?
