According to SS I'm depressed......

This one is right up there with Erica's post.  I got my denial letter in the mail today and it cannot approve my claim because my depression and anxiety is not enough to keep me out of the workforce and due to my physical limitations I could be a telephone solicitor.  I was like WHAT the _ _ _ _!  I am definately appealing it but it still torked me off.  I knew they would deny it, they always do the first time, I was just pissed that they came to that conclusion.  The examiners are not even dr's or nurses, they are just people with no medical training who can control one more aspect of our lives.  It was just stupid.  I just had to tell you all.

Hey gal!

I should clarify that I defintely believe folks with bi polar need soc. security, but in this case, I have known this aunt of his for 25 years, and she is one of those who is up at the crack of dawn and the house & lawn have to stay absolutely perfect. She is working from sunup to sundown, doing yardwork, landscaping (how I dream of being able to work in my landscape now!), housework, driving people to appointments, you name it, and I have never witnessed or heard of a mental situation with her. :(  

I am certain it is, fake. :(   It is sort of a 'joke' in their family. Not my kind of joke at all.
I do think she has something of an Ocd, with being obsessed with everything being just so (and my 2 youngest sons exhibit some of this behavior also). But I do believe the BP diagnosis was bogus. :(

Wow, I can't believe it took that long!  My 6 brothers are bipolar and three of them get s.s. because of it.  I should ask them how they did it.  We sure have missed you being here, Sher, so glad your back.

Hey there Lady

It took me 3 years and was denied twice by paper letter. When we arrived at the hearing portion, I think the 3rd appeal? then the judge actually took the time to go over my records and they had a social security doctor to give his opinions. When they saw me 'in person' then they approved me. It took SO long and I was ready to give up, but we knew I could not work, its not possible to depend on this body every day. (Both and judge and the soc. sec. doctor say I have MS, that is how I ended up at this forum)

I did hire a SS attorney, and we are sure that did help. They sent an underling with me to the hearing, I was not happy about that at all. He did basically nothing and I did all the talking to the judge. I will tell you one good item I had, was a written statement from my Neuro saying that I absolutely would not be returning to work. The judge went by this statement for a 'negotiation' (she was doing this to everyone there that day we learned by talking to them). Basically you had to agree to give up alot of your owed backpay in return for being approved. Gotta love this government. Not. She went back to the date of my letter.
My attorney took a large portion of the backpay I recieved- 25%. I might not have been approved without them, I think they did some behind the scenes work with the judge from comments I heard. So it prob. is worth it to get the attorney. You might have a long wait gal, unfortunately. I have heard they try to 'starve you out' . But if you can't work, you just end up starving. :(  

My husband's aunt got approved years ago very quickly- she went into the doctor and told them she was always hearing church bells. She ended up diagnosed as bi polar and was approved right away. All along I thought.. maybe I should go in and say I'm hearing Bob Hope singing!  ROFL  It does make you sick to your stomach to know how bad off some people are and they are denied over and over. I would definitely appeal, get letters from your doctors, copies of your tests, to be ready after the long wait for the hearing appeal.

Thank you Everyone, I value your input very much.  Quix, I didn't know they had a stamp like that, thanks for telling me that. Glad your pix is back, I have to laugh everytime I see the salad tongs!  T-Lynne, oh Honey, when I had an appt with a S.S. doctor, my hubby went with and told the Dr I was depressed.  The only thing the Dr had to say was that I should not be responsible for our checkbook because of cognitive issues!  I guess he should of said because your wife is depressed she should not be balancing books!  Good luck with your hearing, I wish I could be there for you when you go.  I definately will be hiring a lawyer to sort this mess out.  Again, thank you for the info and insight.  You guys are wonderful to me.

Wow I am so sorry to hear that . It does not sound good enough and agree with all the others you need to get some help fighting that diagnosis.  

A legal consult sounds like the way to go.

I had a friend working at the SS disability office.  They had a RED STAMP which read "Represented by counsel. EXPEDITE".

I agree that you need a better diagnosis than that.  How many neuros have you seen?  

It would not hurt to get a legal consult early.

OH, THIS HONKS ME OFF,

THE SOCIAL SECURITY ADMINISTRATION IS AS BRAIN DEAD AS MANY OF THE DRS WE HAVE ALL ENCOUNTERED.

WHEN I BECAME DISABLED AFTER A BACK SURGERY THAT WENT HORRIBLY WRONG, I HAD TO FIGHT SS.

THEY WILL PLAY THAT GAME,WELL YOU CAN BE A PHONE SOLICITER,BULL PUPPIES, DON'T LET THAT WASH.THATS THERE TACTICS.

WHEN I WENT TO MY APPEAL HEARING, THE OCCUPATIONAL IDIOT FOUND A JOB THAT I COULD DO ,IT WAS 2 HOURS FROM MY HOUSE,BUT SHE WAS VERY ASSURED THAT THE MAJASTRATE WOULD FALL FOR THAT ONE,NOPE HE DIDN'T.

YOU FIGHT GIRL,DON'T GIVE IN TO THEM,THEY NORMALLY DENY THE FIRST TIME AROUND,IT TOOK ME 2 YEARS AND I DONE IT WITHOUT AN ATTOURNY,BUT DID HAVE ONE AVAILABLE FOR HELP WITH QUESTIONS.

SEE THE SS OFFICE THEY THINK THAT THE MONEY SET A SIDE FOR DISABILITY PURPOSES IS THERES.

YOU CAN REQUEST A COPY OF YOUR FILE,FROM THERE EXAMINERS REPORT TO YOUR DRS REPORT.

WHEN YOU APPEAL, YOU WILL NEED TO KEEP FIBRO IN THE BEGINNING EQUATION AND THEN ADD THE ADDED DX OR YOU WILL HAVE TO START THE PROCESS ALL OVER AGAIN.

  It is just crazy how they make the final decision when they want to etc.  My dx's have changed since I applied in December but when I first applied it was fibromyalgia as the dx.  And with the latest dx with seizures, there is no good evidence, my EEG's have been normal so that one just is stupid.

After Monday, I hope I know a dx.  They better get something done with my hip though, it feels like it is splitting open.  I can't explain it, it hurts like nothing I have ever felt til now. I have been using everyones advice, warm baths, the rice roll, Lortab. Thanks again for the other day.

I have a friend trying to qualify for SS due to her fibromyalgia. Expect a long process. The first time, it was denied.

Then her hearing was going to be in January, then got pushed up to the end of April!!

My dh works at an attorney's office (he's the file clerk, but everyone in my family calls him because they think he's the legal eagle and can get info!)

Anyway, my friend's SS atty./dh's coworker wasn't at all fazed that this is what happens, it seems to be the (time-wasting, life-changing, irritating) norm.

Did I say that?

Hi Ada,
   You always have a better chance of getting SS disability if you have an attorney who specializes in SS disability handle the application for you.  They will take a portion of the first check and that is usually all they charge.

For anyone trying for any disability, a piece of advice.  If you can, don't let the primary reason for your disability be listed as anything psycological, such as depression, anxiety, etc.  There are alot of private disability carriers that have time limits on mental health benefits, where as they will only pay for about two years and then they stop.  (I don't think social security does this, but I know they want to see physical reasons WHY you can't do a job.)

If you can, have doctors list something "physical" (fatigue, pain, whatever) as the first reason, and anything like depression as "secondary to the physical condition".  I don't know if anyone has private disability they are applying for (I did) or how Canada or other countries work.  Just thought I'd throw this out there, from personal experience.  Love to you all, Amy

I know more about medical carp (yes, I did that on purpose), than my doctor, I swear! LOL
I haven't even tried to apply for any sort of disability as 1)I wouldn't qualify for CPP since I spent so much time out of the work force taking care of my kids, and also in school (hairdressing), and 2) I know without a dx my doc wouldn't sign the forms.

My world's been spinning for 3 days now, and I'm fed up with it all. It sucks because we're a low income family, and we could certainly use the extra money any disability would provide, but I know I wouldn't get it. Now my husband is considering a job that would have him away for 3 weeks and then home for 1, just so we can get ahead of the game! That would suck a lot, but at the same time, we all need to survive, right?

Yeah, I suppose I'm rambling on here, about things off topic. Sorry!

I know what you mean about the people living with themselves.  Maybe I should ask social security for a job then? hehehe I could be an examinor for them.  You would think being in limbo for so long can turn a person into a medical expert!

Hi honey...ok so you are at the bottom now I assume...things don't get any worse from here right?  So which way do you go now? UP, UP , UP!!!

I am thinking they will probably do the same with me with my CPP disability but there are a lot of people out there that get this assistance that are a lot better off and a lot worse off than we are so WTF?  What sort of standards do they keep or is it more who you know or what we can do for them?  Makes ya wonder doesn't it?

Wouldn't you like to just ask one of those examiners if they are going to come to your house and physically lift you out of bed and carry you to work cause you sure the he** can't walk!!!  I agree honey and I am pissed for you too!  I know it doesn't help but I am SO SICK OF THE ****!!  I know YOU DIDN"T ASK FOR THIS!!!  I have one question though...how do these people that make these decisions that completely affect the lives of strangers live with themselves when they go home at night...I guess they would have to cause there surely is no one that could LIVE WITH THEM!!!
