can you sue a hospital for

not telling you that you have a chiari malformation in your brain? i've had mine since 2005 & they never told me about it until this year. the doctor said that every CT scan i've had on my head has shown this since 2005. i got mine from being assaulted & never heard anything about it until i went to the emergency room yesterday.

Not telling you about it and not including it on the MRI/CT scan reports are two different things. Was it ever included on a report, even if your doctor(s) didn't bring it up to you in an actual discussion? I had a pineal cyst show up in an MRI and it was included in the MRI report, but my GP didn't bother disclosing this information and I didn't realize the cyst existed until I read the report, myself. Additionally, were you experiencing any symptoms that would warrant concern for your health and well-being? As in, what were the CT scans originally ordered for? I don't think you would have much of a case unless you can prove that you were seeking medical attention as a result of neurological problems you were experiencing, and that the doctor(s) who ordered the original CT scans and the radiologists who read your images missed a very obvious diagnosis, causing you several years of potentially unnecessary symptoms and/or endangering your well-being.

Hi...unfortunatly u r dealing with opinions...most radiologist and NS when in med school did not spend much time on chiari and therefor do not have the most recent veiws and ideas on treatment or need of treatment.....

R u sure ur chiari is aquired or was it triggered from the assult.....a fall or amusment park ride can cause a chiari to become active.....U may find more info on our chiari Forum here on MedHelp...I am the community leader and I invite u to join our forum.It is a great place for info and support!!

I was wondering the same thing. I went to the ER in 2010 because i became very dizzy, my head felt like it was splitting in two, and was vomiting all over myself. They gave me a CT scan and said it was a vascular migraine. So i followed up with my doctor and he prescribed me migraine medicines. April of this year I left work early because my migraine was lasting 4 days and my medicines werent working. Went to see another doctor within the same practice as my original doctor and he was going through my charts and said there was a malformation found in my 2010 CT scan. He couldnt access the details so i had to make another appt. With my doctor the next week. The second he came in he pulled up my chart and said you have a chiari malformation. 6 years they knew this but yet they didnt feel that it was important to tell me? 2004 he diagnosed me with excessive sleep somnolence and depression. 2010 migraines. Now looking back i could have taken note of some of the other symptoms. I feel that this is very wrong.
