Are Drug test required by law or by doctor's law?

   My primary Dr. clinic I have been using for atleast 20 years in my hometown about 2-3 years ago swapped out the PA-C to the one I am using now. In the past I have never asked for any type of pain medicines from this office or any office. I was in an accident 5 years ago, a tractor trailer came off a ramp which was backed up during rush  hour too fast and rearended me and knocked my vehicle a little over 100 yrds ( measured on the police report) and totaled my car. I was taken to the hospital with severe nack pain at the time did xrays gave me pain meds and sent me home. I hurt real bad for a few days thinking it would go away after a month or so I went to see a specialist. He did countless mri's/scans, xrays prescibed some pain medicine ( I didn;t ask for just doing what the Dr said never got it refilled just used the one month). I seen him for almost a year with my insurance only paying for a small portion of the bill. Over this time I lost my Job due to not being able to function properly.  I tuffed it out for a long time as it grew worse and worse. Not sure but about 2 to 2 1/2 years ago I went to see my hometown clinic and met the new PA-C and started seeing him every 3 months. He prescibed me 2 hydrocodone a day 5/500. After a couple visits he told me "required by law I had to take a drug test" which I felt was kinda an insult but I was fine with it and took one every 3 months when i came in and never thought about it again. Oct the 4th I had an apt I missed (simply forgot no excuse). Oct 6th I called my pharmacy to refill my pain medicine the next day htye called and the Dr said no. I call the Dr his nurse said I missed an apt so I made one for the 23rd of oct but he still would not refill them. I managed toget in on a cancelation oct the 16th. He actually upped my dose to three 7.5/500 a day. Also he always for this whole time only gave me enough pills for 10 days at a time but this time he game me 60 @ 3 per day.
Now today on Oct 27th I get a cerified letter staing they will not supply me with pain medicines any more due to Percocet being positive on my test.   20 years with these ppl I get a letter no call or anything a letter....
I did take percocet those few days I was out. My daughter just had a baby and came to spend the 1st week of the baby's life with us to kinda help her with him since its her 1st and her husband had to go  back out of town for a fews days right after he was born. I  know now this was not the best thing to do I should have just tuffed it out but it was hard to tuff it out knowing something to help was just a few feet away.      I can no longer afford my insurance and I cannot afford these pain management Dr's at this time.  I guess my real question is do I go try and talk to my PA-C or just go on in over his head to the MD in the office which has know me for years. He never treated me but he has always seen my kids and knows us well. I have always seen his PA-C . Just always hated the end results of going over someone's head when you may ahve to see them again.

I am so sorry If I seem to be rambling but I am just at a loss atm and read a few post on this site, and being the weekend I have no professionals to call and ask questions.

And, the doctors are worried about loosing their medical licenses and their means to earn a living. (not that i blame them) but i think the rules should be clear and upfront, such as a contract for Pain Management. It makes the rules clear and to the point and it protects our, as patients, ability to continue to receive pain management services.

The DEA is becoming very irrational and the over-involvement in the administration of opiate prescribers gets worse every year. They have removed the prescription priviliges of physicians who do not comply with their "suggested" patient management protocols.

Hi Jake.  I'm sorry to hear your in the situation your in.  Speaking from experience with going over a doctors head, not with dealing with pain meds tho, to the next higher up, no good will come of it, it will just make one huge mess for you that will follow you to your next dr.  I ended up having to change dr. offices all together after my family had been with this dr. for 13 years.  All because of how one of my dr.'s associates treated me and and I complained about it.  Now your situation is different.  It is against the law to take a perscription medication that is not perscribed to you.  The only way you could get out of this is if you could get a doctor to write you a perscription for that same med...percocet I think you said...and bring it to that dr. of yours that you were getting your pain meds from.  It would at best make you look like you weren't getting them off the street.  It would however look like you were dr. shopping or hopping or whatever they call it which is also a big no no.  No one is supposed to get pain meds from more than one dr. I have recently found out when your hooked up with a pain managment dr. for sure. not unless your pain management dr. knows about it and approves it.  Yes, in some states the DEA is watching the pharmacy data bases and keeping track of peoples perscriptions and notifying dr.s as well and patients that are getting pain meds from more than one dr. are getting letters in the mail being canceled because of being caught doing that too.  
I have read a lot of peoples posts and from what I've gatherd it doesn't matter how legitimate someones pain is.  The dr.'s don't care.  They have a zero tollerance policy.  If you screw up that's it, your done.  Hopefully you will be able to find another dr. to take you  on.  You will have to be up front and honest with what happend and bring with you a copy of your medical records.  I hope it all works out.  Post and let us know.

I have never failed any of the other drug test and always stuck to exactly what the DR said.
  I also have not signed any contracts or anything just said ok to the drug test every 3 months.
  Imo I can't see where I failed the test if he didn't refill my subscription and has not told me not to get pain medicine from any other dr's.  

Now that I think about it who's to say I didn;t go to the hospital form pain over those few days and they gave it to me. IDK just seems wierd he would want to kick me to the curb. Frim what I have read seems since he is kinda new he may just be scared of the DEA and I should give him another chance.
