Is this breech of a pain contract on my Dr's part?

I have been diagnosed with have a bulging disc in the c-5/c-6 region of the neck that traps down the Median nerve root causing pain in my neck, shoulder, bicep,and chest. I went and saw a neurosurgeon and he said that surgery would do more damage than good, so he referred me  back to my primary care Dr to treat it. When i got back to my Dr he tried me on a number of non narcotic pain revilers and when those didn't work he prescribed oxycodone 10-325 4 times a day for pain and he gave me a 30 day supply. We signed a pain contract with the basic info in it, but he added that they would not just cut me off and that they would tapper me off slowly if they needed to.So i signed it and he said that he would start seeing me every three mo, but since the offices computers didn't go that far in advance what they would do was when it was time to see me when i called in to get my refill they would tell me it was time to see him. And that worked great until he was called up to serve for the air force reserve but he said he would refill my meds and every thing would transfer over to the Dr that would be taking over his cases including the narcotic contract. This where the nightmare began when i called in for my refill the new Dr tried not to refill my meds claiming i had missed an appointment and i explained to the nurse that i couldn't have since i had just seen my Dr last month and that i only saw them every 90 days, so they refilled them but they only gave me a 22.5 supply so i could meet with the new Dr, and when i have met with this guy he has treated me like i was lying to him about my my pain he even tried to tell me that i had never seen a surgeon and he has asked me repeatedly if i take four a day  and i say yes .. And whenever i call in my refills there is always a problem, whether it be that he is out of town or is not in the office even though i follow my pain contract to the letter and always call at least 48hrs to 72hrs in advance and i have had to use the fact that my contract says they can't just leave me with out more than once..now when i tried to get my refill this last time he is saying that it should have lasted me 30 days when he only ever gave me a 22.5 day supply which is 90 pills taken 4 times a day like the script says  and it always has for 3 years and he has left with out any type of pain killers as of today.. Is this not a breech of contract on his part? and does fall under his oath to do no harm knowing i will more than likely go through withdrawals over this?

This would be up to your Pain Doctor, if he/she will "take you back."

I'd show up there, looking my absolute very best, with a handwritten letter, owning up to whatever they think you let them down on, showing you made all the changes ("Doctor, after thinking really hard about what I did, I now realize it was a mistake to take my friend's medicine, I know it was selfish at the moment, all I could think about was my own pain, and not enough about how my actions affect others" etc., etc.,).

When you arrive, ask to "see the nurse," and then personally hand the letter to the doctor's nurse (not the receptionist).

I don't know.

I think if you do all-the-above jussssssst right, you'll have a good chance. What do you think?

I breached my opiod conract agreement, It has been a year since I been back, can I be re-instaed to get pain meds again from the same doctor.

the thing is with the contract,,is that if you have narcotcs seeking meds,,its in a data base all over the globe..i had 1 time,it meant that cvs had to sighn it and me..there wasent all that ,,that you said..it said that if a pain doc issues narcotics..they can be withheld from you,like if your at 2 days earier,,i know your alowed this time,to them its red flags!! i,m not a medcal doc i,m a m.d. advocate!! a md can tell you anytime for no reasons to drop you..but in all areas of medcal they have to issue you a written 30 days to seek another doc...sounds like the newer doc pushing his limits and at you..i see a lady pain m doc,shes cool, 4 perx 10mgs aday..i get my new ones tommrow..i,m 1 day early,,but i never go early,i,m not out just be out tommrow so why waite last min.. by law your doc can not say see you in 3 monthes not on NARCOTICS!!! 28 days or more to see you..me i seen her 1 week ago..get them tommrow..you said the doc told you 3 monthes..hes WRONG..you look that up anywere google it..its every month..the ( dea) would be wondering why he does this and suspend him..now say tramadol you can get 90 pills its not a narcotic,,but works as 1..were i go to pain m..thers people nodding there..and the docs wont even see you if they think your doing to much...so you may be taking your contract wrong way..there all the same all over usa neaways are..its a 3 party contract..you your pharmist,pain doc..and ur doc goes over these,,everytime he prescribes these,,yes you need to have them,,or major withdralws..you may need to look for another doc..but chances may not be there if its documented from your doc of RED FLAGS.,.

I am sorry to hear this, its rediculous! I mean percocets  are not even what is being abused an he is treating you like a dope phene 20 yr. old kid! Its is normally the DEA scaring doctors into giving what they know you need and scared to lose there job! But this guy seems just like a jerk! I would at the least report him to Better business bureau! And put under his reviews online what he has done to you and how cold and disrespectful he has been no right to treat you like that! I would also report him to and I can't think of the name but there is a place to report doctors who are breaking the oath they take! Google it, also your primary DR. can write you percs., you do not want to have to go to a Pain management place for just those cause most dont take insurance and my experience here if Florida you sit with people you can just see are junkies! I wish you the best my mother has gone through similar things with cold hearted doctors!

I think you should have seen this coming especially since he was showing signs of idiocy. I never EVER go get my prescription the same day.. I always go a couple days in advance just in case something happens and the dr is out or anything. I always had a problem with my old dr with always thinking I was trying to Pull a fast one on her... now I see a new Dr and he is very helpful and listens and he gives me the script early knowing my pharmacy wont give me the meds early anywyas!! There ARE good drs out there you just need to find one that fits you. Be honest. I told my dr that I was in a lot of pain and I was going to take an extra pill he sad it was ok, I ended up running out a day early and he authroized an early refill. I had this happen one time and the pharmacy had to call him and he said it was ok even though he wrote it on the script. Some pharmacies are A holes too. I definitely dont suggest anyone taking more medication then prescribed I just wanted to share this because there are doctors that listen to you and actually care about your pain and not just think you are lying! You can tell a Dr cares when he will try non narcotic meds before giving you the narcotic meds. I am sorry you had to change docs and the good one had to go to war but it is time to think of getting a better dr that will listen to you and not make assumptions. Good luck

Again, I just want to clarify that nobody should ever take more medication that prescribed without talking to their dr FIRST!

Wow, thats sounds like a rough ordeal to experience and then add in your pain and Im sure it is a nightmare. Im sorry you have to go throught this.
I have been in pain management for over 5 years and its been really ugly until quite recently.
I have had doctors tell me the same thing, even after sitting down with them and doing a full pill inventory (physical pill count) of my medication bottle, and then he would refill it, but the next time he would get funny about it, like he forgot that we did an inventory, and it made me feel horrible for many reasons. 1: that he was treating me like Im stealing..Even though I never ever refilled too soon, 2: that I was even in that situation to beging with, and that I had to ask or expect anything from him, because he was and is still a jerk.
With that said, if he's gonna get funny at refill time, I think it would be a good idea for you to find another pain management doctor. That "agreement" that you signed at the beginning of your treatment is really for their (the doctors) protection and as far as I know, it really offers nothing for you the patient in the lines of protection, other then a general outline of rules. Mine always had a stipulation that they could cut me off at anytime, as part of my treatment. Some doctors just hate to write for narcotics, yes even PM doctors, this much is true.

With your primary doc at the war, I would waste no time in getting a new PM doctor. MY advice is to notate any and all meds you have been on or tried,, any and all procedures you have tried, document everything, so that when you see your next potential PM doctor he is up to speed with your treatment and hopefully he will help you out without having to do or try things that you have already deemed as not helpful. I myself have been down this road and it *****. Some PM docs simply wont write nar scripts, others may, but you have to let them do their thing first, in my case, it was courtisone shots at $1000 a pop.
Finding a good one was very hard where I live, but dont be affraid if he's not the one to help you, to gie him the boot and keep looking for the one that will. It took my 4 years, but as of last month I finally found the right one.. Good luck and please let us know how you make out .
I would also add that you can not force any doctor to write you narcotic scripts. Another doctor would be an easier choice than getting a lawyer involved. Most doctors hate lawyers, I dont think a legal battle would help you..

Hi and welcome! I am a chronic pain patient too, but I don't take opiates any more. I go to an actual pain management doctor. It sounds as though you may need to find a doctor that specializes in pain management rather than a GP. Due to the strict Federal regulations, GP's are getting more reluctant to prescribe narcotics for any length of time. Depending on where you live, pain management doctors are the only ones allowed to prescribe them other than for short term.

Technically, it sounds like your doctor is under breach of contract based on your post,although it may not be if you hadn't signed an agreement with this particular doctor. I know we had to renew our contract every year, take random drug screens, and see a counselor at least once a year. I see my pain doctor every other month and when I was taking narcotics I was given a prescription for a full 30 days and a refill. It sounds like this guy is trying to get you to leave. This is just my opinion. As to what you can do about it, I guess there are ways to file complaints and possibly take legal action. Do you really want and have the resources to go through that? Do you really want to continue seeing a doctor you don't like?

Again, this is just my opinion based on my experience.
