If all else fails go to the E.R. they will access the situation and give you med's no matter what doctor you have. go for it. I
Could you go see a different physician? Do you have a primary care physician that could take over and fill the prescription for you?
I wouldn't suffer in silence. I would make an appointment to see a different doctor and explain the situation to him/her to see if they can contact your surgeon and testify the amount of pain your in since you are only 3 weeks post-op or prescribe your medications for you.
Sometimes, a doctor to doctor conversation needs to take place in order to rectify the situation. Don't give up. I am most certain there is a physician out there that will refill your medication for you.

Thanks so much for all the support, unfortunatly I am no longer in the care of the visiting nurses because of stopping the comudin so that is out of the question. I just feel so sick to my stomach now with taking the motrin and this whole seranardo, I just wish I could make a complaint to the proper authorities. Again thanks for all the support.
I ran into a similar post-op problem with a Nurse Rached at the surgeon's office. In addition to ignored refills, she ignored insurance documentation requests to the point that I nearly lost coverage for the surgery. She wouldn't even allow me to make an appointment to speak with the surgeon, no doubt in an attempt to cover her backside. In the end it was my husband who got it sorted out. He had the surgeon paged through the answering service before the office opened. The doctor was horrified at the nurse's behavior and had no idea what she'd been doing. I'm sure I wasn't the only patient with similar experiences. She didn't last long after her actions came to his attention.
The squeaky wheel gets the grease so keep trying and also try to circumvent the control-freak of a nurse. Your request is perfectly reasonable but her actions are not.
I'd keep calling your doctor's office. Or maybe ask the visiting nurse to make a call; that may get answered more quickly. You're not a junkie. You're still in the early stages of your recovery. Keep calling today and don't let up. You don't want to let this get to the weekend. Let the nurse know if he doesn't call you back you'll be coming in to the office to see him personally. (I had to do that with one of my mom's doctors once. It wasn't a pain issue but I knew she had pneumonia and I knew she needed IV antibiotics. Her doc kept calling different scripts and wouldn't get on the phone. I actually did bring her to the office, and she was admitted from there.)

No I havent exceded a refill date for I didnt have one, and I was right on time with the phymacy label, I am a med cert care giver so I know. I don't know if I mentioned that even if it were a script for motrin 8oomg I probable would feel better knowing that hes really not negligent. I am currently taking tylonel and that is not working. My visiting nurse told me on Monday when I asked about if I could try motrin instead however she said no, because of my taking asprin each day as a blood thinner. This doctor has a secretary who does all the talking to the patients for him, so yesterday I called like my nurse told me to and asked for a refill for something less strong then the original script of percocet She told me that she could certainly ask hime, and to call back at three this was at 10:00a. I called and she told me, " He hasent answered me yet" so call my phymacy at 4:30 to see, So I did and there was nothing called in I called again before closing time and alas no doctors call. Today I called the phymacy to ask again just 4 hrs ago and alas no doc phone call . I almost afraid to talk to her again I just want to through in the towel I have been crying for two days . I feel like I a junky.!!!!!!! I so hurt everything was fine before the surgery.

I think if you supplied a little more information you will be more likely to get responses. For example, did you happen to run out of your medication before the refill was due, is the surgeon someone you've had a long relationship with, have you tried contacting your primary care doctor for helping in getting in touch with the surgeon's office, etc.
I hope you will continue calling the surgeon's office. No doctor should ignore any patient's call (within reason,) especially so soon after a surgery. In the meantime, maybe your primary care doctor could help you with this. They may have better luck in getting a response from the surgeon's office.
Personally, I feel this is negligent. Often we are at the mercy of our doctors and sometimes we have to put up with behavior we don't like. Though I would certainly start looking for a different one as soon as you're well enough.
