I just found out that im disabled and mite be forever. I want to know even if there is no proof that the surgeon did it when he was doing surgery. But could the nerve damage have been stoped or not got as has bad if it was caught early on. my surgeon would not listen to me for  a month so i went to see my GP and by the time he got me in to git some test done and he done the best he could for me but i just found out yesterday and it has been about 2 months i would like to know if it would be wise to git a lawyer. would like any input

Mollyrae is right. Anytime before you go into surgery they have you sign a consent form that explains what they are doing and the risks involved. I know with nuerosurgery one of the risks is always nerve damage, permenant or not. When I had my fusion they almost killed me because they were retracting a blood vessel and then doing some drilling and did not notice the retractor tore the blood vessel open. It took them awhile to find out where it was coming from and by the time they fixed it I lost over 6 pints of blood. They had to do transfusions and fluids. Even with that happening if I had died my family could not have sued because it is a risk we are willing to take when going into these kinds of surgery. Now, if there is gross negligence then of course you would pursue that.

Have you gotten the op report from the hospital? It will tell you if there were any complications during your surgery. I did not know how bad my blood loss was until 5 years after I had my surgery when I had to get the op report for another doctor.

Are they suspecting nerve damage or could it be nerve entrapment? What tests have they done for you? Have you had an MRI or anything like that to look at the nerves in your neck?

Just some suggestions to hopefully find out what could be going on. I really do hope things improve for you. Just stay vigilant and keep looking for the answers. Find a new doc if you have to. We have all been there and know how hard it is to find a good doc who will truly listen to you and take the time to listen also.

I have to agree with Dezdon and either talk to a Lawyer or Google it. In your case, you might just want to call a Lawyer and chat with them. I don't know if there is anything that could be done. Every Doctors opinion is different.

Surgery in the neck area is always risky because of all the nerves involved. I'm sure that the Doctor has his back hind covered with the release you signed before he did the surgery. Take care.........

When I had a question about my disability issues, I Googled "Malpractice" and there are several websites by lawyers. I fillled out a online questioner, and the lawyer responded with 48 hours via email.
Unfortunitly, for my case, it was a very grey area and he choose to pass on my case. I havent pursuid the issue any further.
I do recomend a clear, well typed (unlike my posting reply...LOL!) "too the point" discription if you choose to fill out a online questionare. Like anything, it kinda has to attractive reading to get thier attention.
Thats my two cents
