34 weeks

I am 34 weeks today and I was thinking about the Birth of my son and stuff in that nature the father of my son is now in prison and will not be here to see our son being born I was wondering does the father need to be there to give the baby his last name ?

Even if ur not married it doesn't matter U can give ur baby his last name.

No he doesn't. You can put his name on the birth certificate. However, if he then chooses not to claim the child, it doesn't matter if he is on there or not. The court would make him take a paternity test.

You can give your child any last name you want it technically doesn't have to be your or his

I'm sorry to hear that. No, the father does not need to be present. I can't remember if we both signed our daughter's papers or not, but you can legally give your child any first and/or last name you wish.
