Are you kidding me?

I am 10w1d. When I was 8w I was given a note for restrictions for work. I had to have a break every 2 hours, and I cannot lift more than 20lbs. I work at a Kroger marketplace in ohio and it is run by a union. My job is a home goods clerk, and I am supposed to be able to lift couches, love seats, recliners, 300lb boxes of dining room tables, heavy furniture. It is in my job description to have to be able to lift 45lbs. The note also said I could STILL work. They are trying to force me to go on leave. I wasn't going to go on leave until a week before I was due. Which would have made it to where my job would be held, and my leave would be paid because I would have had to have been there a year. Now I won't have any income to support myself or for appointments and food and I also have bills to pay. If anyone has any advice, please let me know.

I could try for a "lay off" and see where that gets me.

Would they lay you off with a return date...like 8 weeks after baby is born??
My employer didn't do maternity leave, and I couldn't do much anymore, but he didn't want to lose me entirely, so he decided to lay me off due to "lack of work" and we came up with a return date so unemployment didn't hawk me to find another job in the mean time. If you can get laid off, and apply for unemployment, don't mention being pregnant because they will not give it to you.

I was just looking into unemployment and you are right if I quit then I'm ineligible .

No they won't discharge you for being pregnant they can discharge you for no longer being able to fulfill the duties of the job you are in. It's a very touchy situation. I don't know how the union this works but I know that I they get tired of it they can legally let you go. And no they can't force you to leave but I have done paperwork with employees that refused to go and so they were literally scheduled to work 1 hour a week. Every week. Until they quit.

My next scheduled work day is Saturday. Im calling the union all week to fight. And if I can't fight it, I'm calling Saturday and quitting so ill have a chance of getting a new job.

Thats not right.where i work you can change to different departments to accomodate. Id look into talking to a higher up. Its not like youre giving up or quitting.you want to work and need it.but look into higher ups.this is messed up.im so sorry hun

I've asked to be cashier. They come out with a straight blunt no. It hurts being treated this way. I feel like they're treating me like a disease. But when a manager was pregnant, she could stay until 2 days before she had the baby.

With that you could get unemployment its illegal to discharge an employee for being pregnant. Thats what happened to me i was fored for being pregnant and immediatley got unemployment benifits as well as food stamps and WIC

See if you can be a cashier for the time being. Im a cashier,28 almost 29 wks pregnant and i still work.the heaviest thing is dog food.but if you ask customers nicely to just pick it up so you can scan it with the gun,theyll be more than happy to with you being pregnant.all my customers understand and you wont hurt yourself.hope it works out :)

I've been trying to get ahold of my union since I've found out about this which has been a week. And no one will call me back and no one will answer their phones.

I would stick to your job, they cant force you to leave. I woukd also make it very difficult to work for them, taking your break every 2 hours, not doing heavy lifting. can you not get extra advice from your union?

The heaviest thing a cashier lifts is 12 pack of pop and there's no way those are more than 20lbs. I asked for cashier and they straight up said no.

I've tried being placed somewhere else. They said there's no other place in the store that would go with my lifting restrictions. I'm going to try and fight it but if I can't then I'm just quitting so I can find a new job.

They could just fire you. There are laws against firing women BC they are pregnant but those laws are null and void if you are no longer able to do your job. Seeing as your job description says you have to lift at least 45 lbs and your doctor is saying no way Jose then they can legally let you go. Ask about a transfer to another department until baby is born.

I'm 34 weeks and was released from my job yesterday due to restrictions on how many hours I can work. :/ I hope they can resolve it and place you somewhere else
