What is the infected part? If someone has genital herpes, they have it "everywhere" in the genital area. Herpes infects nerve groups, and genital herpes infects the sacral ganglia. This covers the entire anogenital area.
So even if a person doesn't get obs on his penis, he is still infectious from the penis.
