disability claim denied

by staraiski, Jan 30, 2008 11:59PM
I am a 57 year old male. I worked at a meat production plant. I lost my job on 8/29/2006 and have not work since then. I had  MRI in November of 2006. I have lower back pain that sometimes just about cripples me. Cant walk, sit, sleep, sit in a car for more than an a hour  without major pain. I had my pain medication bump up this year because my pain got so bad I could barly function. I was denied benefits this month, but they were based on my first MRI results. I just recieved a follow MRI this month because my doctor wanted to see why my back pain increased so much in this time span. Here is my results from my 1 & 2 MRI and some comments feom another doctor. I would like to see what you think. I would greatly appreciate your view on this case.I also have had all of the cartilage remove from my right knee in 1999, which is acting up again and my left knee is giving me problems also. I have not even  address these yet. Needless to say I am also under a great mental strain because of my financial going from a upper middle class income to using up my savings and living of credit cards.

Thank you for what ever you think.

I have major back pain and it is really painful 90% on my days and nights. Right now I am at the max allowable on my pain meds. I have had two MRI's done about one year apart. I will post the conclusion and see if you can tell me anything from it before I type the whole report.
First report,
1. Multilevel degenerative findings and disc bulges with annular tears posteriorly at L3-L4,L4-L5 and L5-S1. These tears are associated with central dic protrusion at L4-L5 and small left paracentral disc protrusion at L5-S1. 2. No evidence of high grade central canal stenosis.

# 2 report
1. Multilevel disc degenerative changes. There are annulus tears from L3-4 through L5-S1.
2. There is neural foraminal enccroachment bilaterally at L4-5 and L5-S1

I forgot to mention that I was sent to a surgeon and was told I had too much damage to try and repair.

Hello. ( this was the first opinion from one of your forum doctors)

The report does show a major part of your lower spine to be affected. But I would differ in saying that surgery can be done to repair the areas on priority. The neural foraminal encroachment can be repaired first to relieve the pressure on the nerves.

I appllied for disability and was denied. They said that I could still perform my old job as a mechanical advisor which means I would be subject to alot of walking in cold temps, climbing stairs and ladders, hazardous materials, long hours and at least 6 days a week but many Sundays too.
This job is a salaried job which means I am on call after hours. There is high speed machines and many other hazards. After reviewing my last MRI and the meds I take( Vicdon 10/325 and 50mg Tramadol 2 pills every 6 hours.) Do you feel that I could perform this job in a safe many? I know you do not have all the facts and I will not hold you to a answer.
