3 1/2 year old constantly moving

My 3 1/2 year old is displaying behavior that I question.  He will be sitting at the table eating dinner and pushing back and forth on the chair without even realizing he is doing it.  He cannot sit in one place for 5 min. at a time.  When he does sit he is tearing apart a piece of paper, picking at his lip, or uncontrollably moving about a body part.  I am very concered for his cognitive development as well as his overall growth & development.   Is this abnormal?  He does not listen to me or his father at all.   Sometimes he is sweet as an angel and at other times he is a wild, out of control monster.  
He will be 4 years old in June, and still not potty trained.  He has no interest in using the potty.  He is in a preschool 3 days a week and he sees other children using the potty, thought that would help but it has not.  My hands are tied, I love him to death but he is exhausting me.  HELP!  Is this  behavior showing me anger that he may feel, anxiety, confusion?  His father and I have been apart since he was born and for the 3 1/2 years he has been alive we have been fighting in court for custody.  I do not know how to help him.  Please give me some guidance & direction.  Thank you.

I have a 4 1/2 year old and he is just like that.  He can't seem to sit still to save his life unless he is extremely tired or sick.  He also just finally got potty trained during the day but still is completely wet at night.  Don't sweat it they all move at their own pace.  He was not interested at all for a very long time and it drove me nuts.  Keep encouraging him to try but don't push the subject.   As far as his energy goes make sure he has some time every day doing something active to release some of that pent up energy, but believe me some boys have a lot of energy.
