There is usually no hard and set rule about this but, as children get older, the courts are usually more and more interested in their thinking about custody. For example, by the time a child is fourteen or more, the court is usually very interested in the child's opinion. The main reason that it is impossible to set an absolute age limit is the fact that children vary so much in relation to their developmental status, maturity level, cognitive abilities, etc. For a thorough discussion of the custody laws in New Jersey, you can look at the following web address.
