A girl is claiming that my boyfriend is the father.

Hi. My boyfried had a 1 night stand with the sister of his friend months before we met. They had sex on Aug 21,2016. They had the 1st ultrasound on Sep 17, her LMP was Jul27. The result was she's 5weeks and 4 days. The baby is almost 14 days older on the possible consumption. Is it possible that my BF is not the father?

Wait I got confused. The girl should be 7 weeks 3 days on the day of ultrasould from LMP (Jul 27, 2016). The result of the mean sac diameter is 5 weeks 4 days. The EDC is 03 May, 2017. So still the conception is later the Aug 21?

Counting from the last period only works if the woman is super-regular, like clockwork, every 28 days. That is the assumption all calculators use. The first day of the last period can't be relied on to be two weeks before conception for some women, lots of women have irregular cycles.

If the ultrasound in September said she was 7w3d and not 5w4d, there is a good chance your boyfriend is not the dad. But are you saying all of this again  because you feel that if they indicate she got pregnant a couple of weeks earlier than the time with your boyfriend, he won't need to take a DNA test? That is totally not true. Ultrasound numbers like this are not enough to get someone off the hook for paternity.

Especially since he has already signed some kind of paper saying he was taking responsibility for the pregnancy, he absolutely needs an official DNA test that will stand up in court. Call the family courts in your area of jurisdiction, and get the name of approved labs. This cannot be done by a test you buy at the pharmacy, it has to be done at an official lab or it won't be admissible in court.

And he probably also needs a lawyer. Does he have a copy of the letter he gave to her brother? He was pretty dumb to sign anything until he knew for sure (by DNA test) that he was the dad. Fortunately, a promise to her brother is not a legally binding promise to her, but you never know. A lawyer needs to see the letter and tell how much trouble it will cause.

Time for a DNA test, done at an official place, with the samples handled by neutral third parties.
He already consulted a lawyer and inquired from a laboratory. He demands a paternity test as soon as posibble. The other party said that they will set the date. I think the girl wants a marriage since I saw she posted a picture of him on social media and commented that he is her future husband but she's merely an acquiantance.

Anyway thanks a lot for your comment.
His lawyer can tell him how binding his earlier promise was. If he promised to take care of the girl during her pregnancy and didn't mention a DNA test as a condition to that promise, he might owe her some money. The lawyer should see exactly what he is facing.

The lawyer should also see what lab is being considered and confirm that this is a lab that handles the samples appropriately to be considered binding in court.

Good luck.
Yes the lawyer saw the agreement and I also have a copy just in case. In the agreement he only said that he gave a certain amount and nothing more until the paternity test is done. Once it is confirmed that he is the father he will give financial support to the child. That's all. No other commitments. Well we will come back to the lawyer once they set the date.

Your boyfriend needs to call the family courts in your area of jurisdiction and find out what labs are approved for doing paternity testing.

The ultrasound evidence has two conflicting pieces of information on it. The 5w4d measurement has him as the father (and so does the May 15 due date). The May 3 due date does not even match the 5w4d measurement. He needs to test.

This should be the kind of testing where he and she and the baby get swabbed at a lab and the samples are handled by a neutral third party.

The 5w4d count and the May 15 due date give him a very  good chance of being the dad. He needs to test, lest he owe back child support without even having a chance to know for sure. If the test comes up positive, he should talk things over with a lawyer.

He supported the mother on the first few months and then stopped because he wants to confirm 1st if the baby is his. He offered the other party to have DNA/paternity test and the girl said that the test is too expensive for them to have. He is willing to pay all expenses for the test. For the past months before she delivered the baby, the girl is demanding for money support. He can't give any. We contacted the brother of the girl and he said they will set the date of the test.

Recently, she contacted the sister of my bf thru facebook and said she haven't received any amount from her brother from the start of her pregnancy and saw hurtful words from her relatives. My Bf had a signed agreement dated Oct 29, 2016 with the brother of the girl and gave a certain amount indicated in the agreement and mentioned there that he will no longer give any amount unless they have done the paternity test and confirmed that he's the father.

Her LMP was Jul 27, 2016. On the ultrasound the exact result was "Early intrauterine 5 wks and 4 dys by mean sac diameter". Her EDC is May 3, 2017 and AOG is 7 wks 3 dys. This is all based from the ultrasound on Sep 17, 2016. The baby was born thru C-sec on May 5, 2017 since the mother was in labor for 3 days and the baby already pooped inside her. I tried the conception date calculators online based on this result and it revealed that the conception is on Aug 11, 2016. My boyfriend and her had sex on Aug 21, 2016. Hope this clarify my question.

At first, my bf is ready to be a father but he douted if it is his from the result of the ultrasound. He assumed that the baby was already 11-12 days before the day they had sex based on the ultrasound results.
On Jan 4, 2017 ultrasound it says she's 21 wks 2 days (+/- 7) AOG. Her EDD on that was May 15, 2017

Hi, what does "the baby is almost 14 days older on the possible consumption" mean? If the baby was seen by ultrasound and measured 5 weeks 4 days GA on September 17, that points to conception on August 23, which absolutely could mean your boyfriend is the dad. -- I assume you are aware that when a doctor says "x weeks 'pregnant,'" he or she means that many weeks from a computed first day of the woman's last period, not that many weeks from conception? The ultrasound looks at the baby's size and its computer adds two weeks at the front end (before the baby was conceived) to reach a supposed first day of the last period, even if that is not the actual first day of the last period. A two-week allowance is always added at the front by any medical person, to calibrate with when an average woman's last period would have been given a baby the size she has.

Incidentally, in your other post, you said her due date was May 3. This does not square with being 5w4d GA on September 17. Can you clarify which number she got from the doctor and which one was something someone computed at home? There seems to be a misunderstanding or disconnect somewhere.
