The law assumes the truth can never be known so law depends on body of evidence. Since with time evidence and knowledge changes "truth" changes. However at least in the USA trial lawyers insist that plaintiffs be they physicians or companies should be sued on the basis of science/knowledge that was completely unknown at the time of the action. This is the basis of some of the litigation like astebestos that is draining the life out of whole companies, has cost scores of billions of dollars and driven many companies out of business with most of those billions going to the lawyeers and their firms rather than people that actually have asbestos.
It's an imperfect world and evidence based science is still the best way to find our way through an ocean of unknown knowledge.

I do agree with you that the doctors at Emory know. But the rest of Georgia doesn't. Several years ago the AJC did publish an article about the Vitek TMJ jaw implants that helped patients around the world. These implants were recalled by the FDA. I am one of those. Yes indeed it is a slanted world in regards to the truth.
I trained in Atlanta at Emory and I know the MDs are not clueless. I also know the Atlanta Journal Constitution is not really interested in the truth or in impartial reporting of the news. They have their own agenda.

Please try to get it into the Atlanta Journal Constitution. I have tried to have a letter published regarding all these issues but no one is interested. I'm sure professional input will have more pull with the major newspapers. THe doctors in Georgia are clueless.
The article was uploaded today to the publisher and will be mailed to subscribers within the next 10 days. Until then I can't release it. After it's to readers it will be on the missouri state medical association website open access and I will see if I can upload it to my eye blog. There is a great interest in it and it will be featured in several medical newspapers.
