If the operating doctors had taken your informed consent before the surgery you cannot sue them. Before the procedure the doctor might have explained you the expected side effects after the surgery and chances of failure. Pain after surgery may be normal for first few days. If the pain is persistent it is best to get a clinical examination and work up done. See your doctor. Hope it helps.
Best wishes and regards!
