syringe question

i got my blood test on 23 rd may and the guy couldn't get only 1 ml blood out of my vein he used dispovan syringe made locally in India.

i have heard  stories that 30 percent of syringes in India are repacked used syringes .
If the syringe was repacked used syringe on a hiv person and i used it for blood draw am i at risk?
i guess it would take one or two days minimum to repack and bring in market.
can virus stay alive  for that much time in needle of syringe?

and when can i test for hiv ?

sure 30 percent of syringes in india are repacked its in news here.
