unemployment

now that my doctor put me on as disabled and out of work. can i draw any umployment?

Hey there, brmb! I see this is your first post. This is a pretty large site, so diving in can be a tad confusing.

You've responded on the Multiple Sclerosis forum to a post that's over 4 years old. I don't think the original poster or the respondents are active on here any more.

I'm so sorry you're in a tough spot. I hope someone is able to point you in the right direction for the information you need. Even if it's not related to MS, feel free to look around. There are some smart people here and a lot have had to deal with the headaches of disability, the VA system, and some of the less competent members of the medical profession.

Hi I was recently laid off from work, cause Dr. Knew I was having issues with my back and needed back surgery so laid me off and told unemployment it was due to work reduction I was approved for it but I was told to call a 1800 number within 7 days I did and was asked questions like can I work and Have I looked for jobs, I've told them I'm having surgery on Aug 22, 2013  so was asked can I work now and I said well I'm having surgery tomorrow. So she wished me ea speedy recovery and said OK well your next filling date will be eon Sep 4, 2013 now today a day after surgery I get a phone call from unemployment to call them back for determination on claim need to ask me some questions. I'm afraid I said something wrong like I'm having surgery and can't work. I'm scsred any advice?

You would have to be laid off from your position to collect unemployment. Under unemployment, you still have to actively seek employment (at least 2 jobs a week) to get benefits.

Does your job offer paid sick leave/ temporary disability? Your best bet would be what missy & karen suggested. I'm afraid unemployment would not be an option for you if you are suffering from a disability.

Exhaust what your employer has in place for this type of situation, as missy142 states.  After that, most states have temporary disability.  If you are looking at a disability that will last longer than a year, you can apply for Social Security Disability.  (takes a long time to get and is difficult to get)

Some states have SSI; social security supplemental income.  It is quicker and easier to get than SSDI.  You cannot have much money in the bank or have a spouse who is making any money to speak of.

No you cannot draw unemployment unless you are terminated from your position.  Your best bet would be to speak to your human resource department where you work, your boss if its a small business.  These are the people who can directly answer the questions regarding your position, leave time, pay for leave, disablity, how much time off etc.
