Wondering my rights to STD due to bad assault?

About 6 weeks ago I was randomly assaulted, glass bottle smashed over my head, punched while I was trying to order food at a bar.  I suffered horrible head trauma, went to ER, concussion, staples to the head.  Since then I have seen a psychologist a couples times and am now going to group therapy.  My company offers STD/LTD, which I pay into.  I am wondering what my rights are to this.  If a Dr approves time off, can this somehow be denied?  My work is suffering, as I am not the same person since this happened.  Im also not sleeping as well as I was, I am having concentration problems, recalling the event and it is impacting my work performance.  I have never had a work issue like this and do no want to get fired due to low sales performance.  Any help with this would be appreciated, thanks!

no problem, happy to help. Every company's HR department has to have this information by law. If a doctor says he can't work, then he can't. His company has to work with him. They usually do because they fear lawsuits.

Your doctor determines your STD/LTD NOT your employer. It would be illegal for them to get involved in determining your time. You would need a doctor's note explaining the incident, that he/she believes you need X amount of time to heal, etc. From there your HR department should get involved. I don't know your company policy or your state to determine what your STD or LTD is. Your employer by law is required to hold a position for you for 1 year BUT it doesn't have to be the same exact one

I am so sorry to hear about your whole experience.  I am also glad that you are seeing a therapist and group therapy for your PTSD.  

I do know that the Federal Law for taking unpaid leave for your own health with your doctors recommendation is the way to go if you need time to get on your feet and and get your bearings back.  I think we are allowed 12 weeks per calendar year...But don't take my word for this...You can look up the Federal Leave Act on the internet...All the info should be there..
