Got fired from my job

I got fired today because I've been I'll on and off for 2 weeks due to my pregnancy....wow. I even have doctors  notes

I live in VA too and unfortunately. It is an at will state. They cant fire you for being pregnant because that is discrimination. However they can fire you for missing work. Even with a dr note.  The only exception would be if its in the company's handbook having an excusable dr note to be accepted. I would say come work with me. I was really sick and my manager was understanding and just cut my hours back.

I'm sorry to say, but if it is at will, It is not illegal, especially if they say you missing work has caused a hardship on their business.
If it is not an at will state or company, then you can try and fight it. But your best bet is just to file for unemployment. You will absolutely get that. They can not deny you, as you did nothing wrong.
FMLA does not apply, unless you invoked your rights, BEFORE you were let go. And even then, you are not eligible for FMLA if you have not been employeed with the company for more than a year.

It does not matter if your employer is 'at will'. It is still illegal. You are entitled to FMLA which is a federal law that all states in the US must follow regardless of their employment laws. Apply for unemployment and contact an attorney ASAP.

There was a case like this in the news earlier this year. A dental worker was let go by her boss by letter and they tried to make it seem like they were concerned for her health but also said "this is a busy office and can not afford to have everyone dedicated to their job". Total bs, I hope you get justice and they think twice before letting someone go for medical reasons. Best of luck to you! What state are you in?

Thank you so much for the advice ladies! I'm not the one to contact a attorney. In this case I am. I've never been able to get pregnant. So I feel this is my only chance at having a little one. I'm really trying not to stress to much. But it's hard not to. So I'm going to get all my documents together and my obgyn said they will back me up all l the way. Even though I'm new to their office. It's really nice to have all of your support. Thank you!

Just straight forward SUE that company..the decision of the company had surely affected u n health of your baby...this makes a strong ground..

I worked in HR.  That most certainly is against the law. I would first go to your local unemployment office. They can also assist you in the process and with getting unemployment.

I'm sorry for what they did. I'm pretty sure that's illegal because my DIL works for Target Distribution Center in Georgia and they fired her when she was pregnant with my 2nd grand-daughter. Several months later she got her job back because they knew it wasn't right. They were afraid. During her 3rd pregnancy, she was having problems. They were supportive. It was like 360 turn around. I pray your job back.

By chance did you work for an at will company? If so, this unfortunately gives them a right to do shady stuff like this. Either way...I would definitely do as you stated and contact an attorney because your state my have laws that would supercede "the at will clause" and be in your favor despite any at will status.

So sorry that you're having to deal with this and especially during a time that should be a joyous one...employers have become so shady, sneaky and unempathetic (Fortunately I recently concluded working as HR...never again). I wish you the best, hope that everything goes in your favor and congrats on baby.

Hi....I work in the dental industry. I'm ok to work. Especially after getting the right meds to control sickness. My job even knew that. When they let me go they wouldn't even accept my doctors notes...I'm not one to contact an attorney. But in this case I'm am....because it's my first time I've ever been able to get pregnant.  If I loose this baby due to stress. I will probably go off the deep end...

Oh wow this is terrible... I'm sorry I don't mean to cause offence but wherever you live needs to get with the times!!! I live in Australia and it is 100% illegal to fire someone for being sick with medical certificates. That is just horrendous an I feel terribly for you. Please investigate it further as you may definitely be intitled to having your job back or some form of compensation!!

kidneybean,  what industry do you work in? Some work places can let you go if you are unable to work.  For example,  a vet tech in a small vet clinic can be let go for not being physically able to work.

Does this affect your insurance?

That's illegal. I'd be talking to HR workers rights ect I don't know where you're from sorry

Yo u could always go to HR and a lawyer. Know your rights. It may be legal and horrible or illegal.  Im sorry! Wish I could give you a job!
