Baby's father dead, how would baby get his last name?

how would I give baby his last name if he's dead?

I called the hospital they said i have to go to vital records they only do changes when the baby is 7 days old :/ I live in Phoenix Arizona

I guess it depends on state but where I am from u can not just give baby any last name u want unless the person is present or your married to that person. My boyfriend was working at the time and couldn't get to hospital fast enough and when they came around to sign the papers he went to get something to eat. They told me he had to be present because we weren't married. We had to wait until he got back. I'm not sure how it works where u live but ask the hospital how that works. Most of them have vital records in the hospital

I was 3 months when my boyfriend died now my baby is 6 months has my last names and his grandparents from his dad wants me to change it to their last name, the don't live here in Phx az . I ask and they said I would have to go to court to get it changed, also I don't want to get any benefit or nothing any help?

If you are wanting Social Security benefits that would come to the child because the father has died, then there may be some legal hoops to jump through (a DNA test might be expected).  If the father was young and had no work history, there might not even be many benefits.  For questions along this line, you should see an attorney (legal-aid clinics do this kind of thing a lot).  But if your main or only interest is just that the child have his father's name, depending on where you live, you may be able to have the last name exactly as you would like it to be simply by writing it on the form that goes to the vital-statistics authorities when the baby is born.  Again, ask about this at the vital-statistics department or the legal-aid clinic.

That's sad but in Georgia we can't give the baby any last name we want unless the named father is there with identification to sign the birth certificate otherwise they must have the mothers last name as far as death  goes I'm not sure do your own research for your state

I'm 23 weeks and 4 days and my child's father died also by being shot and killed in August when I was about 10 weeks. I am planning on also giving my son his last name. From what I was told, all I had to do was write the last name on the birth certificate but to get survivors benefits for my son,  a blood test would have to be done. I'm not doing all that because the money doesn't matter to me. I just want my baby to have his name. I know exactly how you feel though so if you ever want to talk, message me.

Sweetie, one phone call to your hospital and you'll know or to your state offices that handles vital certificates.  You don't need an autopsy.  That is completely false.  They don't even do autopsies for every person who passes away.  If your boyfriend has a death certificate which is what EVERY deceased person has (birth certificate . . .   death certificate)----  THAT is all you must supply.  Most states would not question you for putting his name on a birth certificate-----  nor would they require you to have a dna test. What could be the benefit to this?  If you seek death benefits or something, that is different.  Your just giving your child a name.  

So, make a couple of calls but that death certificate should suffice for why your boyfriend isn't signing.  Again, sorry for your loss.

I know in the state of tenessee I tried giving my son my familys last name because I plan on having mine changed to my family name and didn't list the father on the birth certificate and when I recieved his birth certificate they changed his last name to mine with out telling me I called and they said he legally has to have my last name since I didn't list the dad and even if I did I couldn't give him any name that he has to have mine or the dads.. which is ********

That is only if you want him in the birth certificate you can give your child any last name you like as well with out going through that

I had this happen to me and I'm sorry for your loss as well as your child ..you will need to get autopsy test so the medical examiner That did the autopsy Will store the blood for two years then you will need to petition the court to have him added it seem like a lot but worth it in the end ..God bless you guys I will keep you in my prayers

You can have a close family member of the dad do a dna test to prove bub is related to dad then they will put dad on the certificate as confirmed father deceased.

Hi there.  Sorry to hear this.  You still list the baby's father on their birth certificate.  That is still the baby's biological father.  You write in the name---  so you choose the name.  You can place deceased by the father's name and that will be undone is what is mentioned above, dad's signature.  I'm again so very sorry your baby's father has passed.  peace

they're right. it's your child, you can name it first name and last name of whatever you wish, the only thing is, he won't be on the signature of the back of the certificate.

You can give your baby any last name you want. You could make it "polka Dot" if you wanted just put it on the birth certificate.
