I live in Tennessee & I'm married but not to the babies father, yes his father can sign it & it will be sent in to the state but the state will remove his name & put my husband on there & baby will have my husband last name, I don't even have my husband last name. When all that happens my husband will have to pay for paternity test to say he isn't the father. I've had 2 friends that this happened to
I live in Florida your husband's name automatically goes on the birth certificate regardless if he's there or not if you're not married the father have to sign the papers I don't know if they'll let someone else sign if you are married and the husband is not the father

It really depends on where your from. I'm in Washington State. A girlfriend of mine just had her baby, she's not married to the father. It didn't matter if she put him on the birth certificate because the father has to sign an affidavit claiming paternity, if he doesn't sign, his name on the certificate is void & wouldn't you know this a-hole didn't sign the affidavit & then got mad at her for not listing him as the father.

My friend in south Carolina was separated from her husband for seven years. She had a baby with another man before the official divorce. She said the father could not be listed until after her divorce was final. The hospital refused to let him sign even though he was there. Now her divorce is final ans they have to go back through the whole process legally. Her situation appears unique though.
At the hospital you'll list his name and both will sign. I had no issues. Just allows you or list both
