Maiden Name ?

Iust have a quick question was wondering if anybody had any insight or has been in the same situation. I am currently separated from my husband. We are going through a divorce, and the father of my child and myself are not together either. I am do in early August. I do not know if he will have the divorce finalized by then.
I know I can give her my maiden name, but my question is can I sign with my maiden name on the birth certificate? Or does it have to be my legal name at the moment? which is my soon to be Ex-husband last name . . any help would be greatly appreciated!!

Thanks.

I would think because it is a legal document it will have to be your legal name at the time.  Which is not what you want I'm sure, but I   would call the country clerks office and ask for sure, pending your in the progress of changing your name. Best of luck.

Are you not giving her the dad's last name because you're not together or are you not giving it to her because he wants no part in her life? Does he know you're not giving her his name?
