i live him minnesota, and the lady that came in my apartment and my landlord were outaide smoking when they seen my boyfriend leave.. The lady dont live in this building so my landlord had to let her in the building i know she knows cuz shes sneeky
@jamaica, our landlord put the letter in the door at 10am.. I took it out as soon as i seen it..
Then at about 2:48pm her FRIEND walked in my apartment, stood there kinda scared and said oh lois (landlord) wants to know if you got her letter..
You can totally sue! First of all nothing in what you posted in the lease states that what she did was validated. Good thing you filed a police report, next thing you have to do is Val around for legal advice and find a lawyer that is willing to take your case. You have full range to be livid, and because what they did was a breach of contract you have ever right to back it of your lease due to fear of your safety. What state do you live in? And do you know if the land Lord really knows that woman walked in or do you think she was trying to break in without landlords permission?
It says they can only walk in if no one is home...meaning she should have knocked first and then if no one answered she would be able to go in...did she actually have a letter or notice with her?
corrissa, this is in clear violation of your lease. There is no clause that says she can send a friend in to try to find out information.
What she said is bogus anyway - since she thought you weren't there at the time, how was she going to ask you if you'd gotten the letter? Who knows what she was doing there.
I would call the management company, or whoever it is that's over your apartment manager and file a formal complaint.

Well make sure you seek legal consulation regarding the matter .. the reason she gave you wasn't justified enough and how do you know that she wasn't there to steal from you
the police said i could possibly sue them depending on what the lease said.
in the meantime just to protect you and your family I would look into getting a camera
I would seek legal consultation .. landlords usually take extra procaution when it comes to entering a tenants home because they can easily be sued for sexual assault, stealing etc. Even if they no the tenant is not home they still are supposed to announce there presence upon entering the home .. I think that's really unprofessional .. I understand what lexi915 is saying but I dnt think there's anyway around the obvious .. she violated the terms and its simple as that
I agree they have go reason to go inside. Calling the police was a great idea,now you have something on record! Also make a point to the landlord that the police have been called and get ahold of the owners! Write a letter or call. Who knows if that's not the first time,and who els are they trespassing on. ..and the excuse that the landlord wanted to make sure you got her letter is not probable cause nor is that reason stated in ur lease .. that's something that could have been handled with a simple phone call
possibly but she can get around that by saying she works for free or gets paid cash. I know it's not what u want hun I wouldn't either but u signed a lease thatbabasically let's her do whatever she wants

@tayy ; that's what i kinda thought. That they had to put a note on your door saying there entering and giving 24hr notice.
I feel violated im sitting on the couch in my towel.
Now i don't even want to be here anymore i shouldn't have to worry about people just walking threw my door.
and theres no proving shes not? Like asking for payroll or something like that..
