child support & Court

Daughters dad & I haven't been together since I've been 4 months prego . Since then , he's only given me 50$ once , Hasn't asked how she is , hasn't gone to drs appts & hasn't bought her a single thing . Now turns out that he wants to fight custody & his mother as well . & we had gotten into an argument & argued various times via text . & he decided to forward all the text messages to to his mother / step son so they can 'see' how I put him 'down' . I don't think by telling him the truth that's he's a worthless good for nothing sperm donor is offending him if its the truth .  Now I don't want his money nor want him to be on the birth certificate . Is there way I can assure NO custody whatsoever ?! I live In California

I'm going through the exact same situation I read this and I couldn't believe how exactly it's the same as my situation except I live in Indiana. child support and custody are different matters. you could file for child support for free by going to the prosecutors office after your baby is born him he has to hire a lawyer to take you to court. lawyers aren't cheap. you don't have to put him on the birth certificate if you're not married and to give the baby his last name or be on the birth certificate he has to file for paternity. I know it is hard but try to ignore his texts block his number if you have to. save ask texts he sends or voicemails don't answer any calls just send him to voicemail this just builds a case for your side. tell him since you can't be civil to not text or call you and that you will file a harassment report with the police it is not harassment of you respond to his messages so don't respond. he has no rights if you are not married only a paternity test can get him anywhere. above all try to stay stress free for the sake of your baby

I'm in texas, and have a similar situation. I would say have a consultation with a lawyer to see what all yours and his rights are, and what you can do. Most will do free consultations. But what the lawyer told me was that the babys father does have rights, but if he wants in the child's life he has to prove paternity, and if he's not on the birth certificate then that doesn't necessarily put his name on it, it just establishes he's the dad. And as soon as he does that he gets to pay child support. And mine smokes all the time too, and if I told a judge that, then I just say the word and he's got a drug test, anytime I want. As far as custody, we live in separate cities, so he would have to come to me, and only for a few hours on the weekend. This is some of the things I found out, it may be similar or the same where you're at.

I understand wat u going through my son daddy aint been around but he want him we went to court he order to pay child support but I talk to da judge bout him getting my son n since we are not marry I have all rites to my son I n Ohio but if he smoking bring it up n bring up his record da state will help a female in ohio before dey help da male

They may or not drug test him.  It really just varies.

Well if u can actially prove it if u have to go to court prove it to hom and he most likely wont get any costody maybe...sorry dont really know how the system works in different areas

If you're talking about him not paying child support for another child, that most likely won't apply to your unborn child. Each case is seperate. The judge will most likely give him a chance at being a parent and will set up days and times he can have custody of the child. He'll have to pay child support and if he doesn't,  he could go to jail.  It depends on the judge too. The judge could rule him out for his bad past or give him a shot. It's hard to say what will happen

Well I have proof that he has never opened bills that were sent to him for non payment of child support & smokes weed everyday plus has a juvenile criminal record

Since he is the father,  he has rights. He can ask for partial custody and the court will most likely give him a shot at being a dad unless you prove he's an unfit parent.

Well she's not born yet and I don't plan on having him there when I'm giving birth

Not really espically if a dna is order but id stay do what you are doing taking care of your baby
