OT--but this seemed unfair to me...

So i went to court today with my sister, she got a ticket for not having her new tags on her truck even tho they had just arrived that day...anywho charges were dismissed woohoo...but here is what bothered me.
As you're waiting for your name to be called you are sitting in a big court room with everyone else who has to plead their case and you get to hear who ever is before you talk about their situation. Well there was a guy there who had gotten a speeding ticket and 2 days later he got deployed to Afghanistan, where he was for 7 months. Of course thinking he should reschedule his court date wasnt on his mind since getting deployed was such short notice. He brought papers of his orders that the judge DIDNT look at and asked if he could just pay the ticket now. This is what she said...

"It is very irresponsible of you to not pay your ticket on time, had you paid your ticket on time you would not have to be in court today. Thats not a good enough excuse, therefore you will have to take a driving class, pay the ticket, court costs and i am suspending your license!" Then as if she couldnt be any more of a b!tch says..."Oh by the way, thanks for all you do in protecting our Country."

I was so p!ssed i wanted to go up to her, grab her by her hair and throw her a** outta that chair!

As a Marines wife...I would have wanted to do the same thing! That is just cruel especially to someone who just got back and 10 days before christmas.

Oh i would have beat the crap out of that judge! She should have cut him some slack, he just got back from serving our country, being away from his loved ones and she does this! He should get a lawyer and appeal her judgment!

Wow!!!  Seems pretty unfair to me too!!!

seems fair to me.. i wouldnt want that person to be treated differently then i would have in that situation just because he was in the military or whatever it is that he does..  everything should be fair no matter who you are.  so in my opinion i dont see anything wrong with it.

that was HORRIBLE. yes people should be treated fairly, but he was shipped out of country. I don't know about everyone else, but when I go on vacation even a few hours away my mind is going a mile a minute in the few days leading up to it....and going overseas...to war? that man forgot. that judge needs a reality check.
1123420 tn?1350561158
he had 2 days to pay it before he left. it takes a3 minute phone call to pay those things.  idk not trying to start an arguement, just think everyone should be treated fairly, and thats prolly what was going through the judges mind as well.. if she would have waived it then she would have started something between someone else, and if she did what she did, she would have made someone else mad, like she did HaynSweetie, so either way she would have been a bad person

IMO again like ammanda said not trying to start an argument...but, he knew beforehand he was going out of country and he did not receive orders just 2 days prior....plus we are taught and teach our children to look up to the ones who stand up for us, i.e, police officers, firefighters, military, etc so for him to be speeding is not setting a good example...speed limits are not there for suggestion, but for enforcement...I also believe that if a police officer is caught breaking the law they should suffer the consequence too...and they too go to work daily to protect us and keep us safe, just like our soldiers do overseas...AGAIN THIS IS ONLY MY OPINION<<<<I AM NOT TRYING TO START ANY DRAMA sorry ladies

I agree that he should have been penalized, but chastising him like a child was out of line...that's just my opinion though.
951898 tn?1296134343
oh yeah, I am not saying I agree with all the added penalties....I mean honestly in most states once a ticket is unpaid for you get failure to appear on your DL which will hinder you from renewing your license and they also tack on fees yearly to your license...So, I am pretty sure he is paying a hefty price for paying so late anyways
287246 tn?1318570063
Yeah ammanda and 5n1, I get what you are saying.  I didn't think he should "get away w/ it" or anything.  I still thought he should have to pay the ticket like anyone else.  But it almost sounded like she gave him unusually harsh treatment.  Would she have done that w/ anyone else?  I don't know.  Never been in her court room.  I guess this could have possibly been his umpteenth offense too.  Didn't think of that.  So I see what you guys are saying too.  But if he got his ticket only 2 days before he was deployed...technically he didn't have as long to pay his ticket as someone else would because I believe you normally have like a month or so to pay a ticket?  At least that's how it is here.  But I guess the mortgage company wouldn't care either.  Anyway, I just wanted to let you know that I do see your point :)
1123420 tn?1350561158
ya here its 14 days to pay a ticket. but like u said about the mortage bill, its the same with cell phone or electric. your not gonna get  a waived late fee just cause u were deployed.  u know. thats why i say he should had paid it before he went like anyone would have to

Me being a military brat and a military wife thought he was treated very unfairly! There was another guy there who missed his court date because he was out of town visiting family and all he had to do was pay his traffic ticket. Which i think is bullsh!t! Im pretty sure she has something against people in the military especially the way she said "oh and thanks for proctecting our country..."WTF!?! she should be slapped! I think the having to take a driving class is stupid and having his license suspended was stupid as well! He was doing 11 over! That is so effing dumb! There are people who do way more than that and dont even have to take driving classes. I honestly think she was just a b!tch who was probably scr*wed over by a military guy before!

And he was on standby for deployment, the guy who was originally supposed to go was injured...he was told 2 days before deploying that he would be leaving. Im not saying he shouldnt have not paid his ticket but the judge could have given him an extension or let him pay the ticket that day. I dont know about everyone else, but if im about to be shipped away from my family and friends for 7 months, a speeding ticket is the last thing that would be on my mind. Spending time with the ones i love and hoping to come home alive would be my main priority.

I personally feel like what he got was a load of bs! Yes, he should've paid it, BUT how many of you that are saying he had 2 days to pay it, would ya'll actually even thought about paying it after finding out your going over seas?! I think not. Im pretty sure that ya'll would've been worried about your family!! I know I wouldn't have given to craps less about that speeding ticket, considering I have a child, & a husband. Ya'll have no idea who he left to go over there! So honestly I think that ya'll should put your self in his shoes, & then say what's been said! Yes the law is the law, & everyone no matter who you are has to obide by them! But people who drive drunk don't even get that much of a punishment!! -NOT TRYING TO START ANYTHING, JUST MY OPINION-

& Thank the Lord I wasn't in the court room, Im pretty sure I would've been sent to jail!!
951898 tn?1296134343
I will say that yes violating the law is still violating the law, but I will agree with you, she(the judge) should hand out equal punishments...there should be no leniency for one and not the other, ya know? but, I guess I cant really even guess why she did it, there could be underlying circumstances, first or second time offense or what not...but, I definately think it is wrong for her to allow the one who was out of town with family to basically walk and the one who was forced to leave pay a hefty toll...that is definately wrong...but, I do know that most states courts operate differently, and have different consequences, and fines...but, I would figure since he was deployed and didnt pay the fine, obviously...they would have just issued a failure to appear, and he would have paid that, which is considerably equal to the speeding ticket itself, and it would be done...oh well to each his own and we all have different opinions on this subject...
1182418 tn?1292437001
Im sorry but i so DISAGREE with the people saying he STILL HAD 2 DAYS TO PAY IT! Maybe he didnt have the money OR MAYBE he was thinking about HIS LIFE AND HIS FAMILY that he would soon be leaving behind! Its so unfair to give someone a slap on the wrist and then give him all these fines! Just because he is in the military doesnt mean he should automatically be a role model...he is human and we all make mistakes. Maybe he joined to support his family, we dont know but this man was treated unfair and if it were my husband id fight this judges judgement!

I'm with Amanda here. It takes 5 mins to call and pay it or send the payment in the mail. so he should have paid it he was breaking the law! BUT he shouldn't have gotten all the extra stuff . Here in Nebraska they just take it off you License and you pay an extra fee when you get it renewed or reinstated. So this man did NOT deserve the other stuff. But again ive read a few ppl saying that their states different so maybe that is the punishment in your state?
Avatar universal
No the punishment for missing a court date here...well for traffic violators...is paying your ticket plus a fine. And i read what Roxanne wrote and i agree 100% with her, especially about drunk drivers getting less punishment! What makes it worse is that the other guy who missed his court date ONLY had to pay his ticket...that was complete BS!
1123420 tn?1350561158
I still stand my own ground on this subject. Yea i dont agree that he got the class or whatever and all the extra stuff.  but, yes he should have paid it. or took 2 minutes to let a family member know to call and pay it.. family memeber or anyone for that matter can pay it for you, it doesnt have to be yourself.   But like someone else said, every state is different.  and i totally disagree about the drunk driving.  I live in Michigan so I know its way different, cause in our state, there so frreaking broke that they make you pay out your ***.  my DB got a DWI, Driving while intoxicated. and got 3000 dollar fine, 6 months probation, lost hius license for 3 months.. 6 months of aa, 3 months counceling, and had to take a druiving impact class.. so he def. got what he deserved.   I understand, being side tracked with leaving your family. but responsibilities are responsibilities, no matter who you are..  Im sure she didnt mean "thanks for serving or whaterver" the way your taking it..  maybe she ment it. you never know what was going on in her head
951898 tn?1296134343
I agree ammanda, as I stated all above...but,I was just not going to post anymore on this subject because I was felt it was about to explode...I think all the ladies completely disagree with us and our stance on it so.....IMO ONLY
287246 tn?1318570063
Not true 5n1.  I did comment that I saw your point as well as ammanda's.  I was just trying to sort of play the devil's advocate.  But the truth is the only way to really have an opinion is to have ALL the facts and we don't have those.  If someone else got more leniency , it could have been that person's first offense.  It could have been the military person's 5th or 6th.  I don't really know and because I don't know, I won't comment anymore either.....
1222635 tn?1366396286
i agree with 5n1 and ammanda. i think that he should have paid it and just because you get deployed doesn't mean you should get special treatment. cops sometimes risk their lives to protect people and some of them often act as if they get special treatment as well. do you agree with that?
maybe she should have been nicer in her choice of words but not in her punishment. and she should have been equally as nice to any of the people in her court--whether they are marines, gas station workers, teachers, chefs, whatever.
we are ALL equal in this country & when he got deployed he should have called and paid his ticket.
1222635 tn?1366396286
no we can have an opinion that he should be treated as everyone else. and who knows? he was overseas for a long time i am SURE. and the other guy was out of town visiting family for what? a week, a few weeks, a MONTH? i am SURE that in whatever state haynsweetie lives in that the penalty is greater for missing your court date for MONTHS than the penalty for missing it by a month MAX.
here, if you miss your court date and dont pay, they suspend your license within one month.
