I would definitely get him checked out. What your describing isn't normal bathroom behavior. I don't want to scare you, but it would be best to find out quickly. With your kitty's health history, normal common problems can cause serious complications.
I have a 4 year old cat who started to become constipated last year. The vet diagnosed him with irritable bowel syndrome (which I think is kind of ridiculous for a cat, but whatever). Anyway, I've been fooling around with his diet this past year. He was already eating a high fiber dry food, so I increased his intake of wet food and started adding a fiber supplement to one of his portions. This food regimen started a few months ago and he is pretty much back on track. The supplement I use was ordered on line and is 100% fiber. It comes in a capsule and looks like sawdust, but when mixed into wet food, he gobbles it right up.
That said, since you cat is older, I would have him checked out by a vet just to make sure that there is nothing else going on.
