The ob-gyn does ultrasounds for different reasons than determining paternity, and more can be seen in the 10th week than in the 6th.  Possibly if a woman had said to a very sympathetic doc that she really, really needed an ultrasound at week 6 to determine paternity, the doctor might order one, but often insurance does not cover ultrasounds being done for that reason.  It is reasonable to think the first guy has a better chance, but a DNA test is the only thing that will be certain.  And that would even be true (because of the short time gap between the guys) even if you had had an ultrasound at week 6 or 7.  You really do need to be sure, it is only fair to all four of you.  I'm sorry your pregnancy has been miserable.

Why would it be hard to tell from a tenth-week ultrasound when you conceived?  They are not precise to the moment.  If it was a sixth-week or seventh-week ultrasound, the projections from it could possibly be spot-on, but even by the tenth week babies begin to develop at different rates.  By week 12, it can be +/- 7 days either direction.

Correct me if I am wrong about your dates --

September 21, date projected by an ultrasound to be your conception date

September 23, sex with guy #1

September 27, date projected by 10w4d ultrasound as conception date

September 28, sex with guy #2

Is this right?  And all the sex was unprotected?

It's just that when there is only five days between the two candidates for dad, that is not much of a margin of certainty.  And by the tenth week the margin for error does come into play.  Given that your later ultrasounds suggest an earlier conception, you might be safe to assume (as a temporary hypothesis) that the first guy has the edge over the second guy.  But this is not a case where things are so certain that you can forgo a DNA test when the baby is born.

My second u/s the due date was June 14 or 15 which make me more believe the 23 is the daddy even tho they still stick with the first u/s

Sorry to have written the wrong date above but the questions still apply.  It should say --

Your estimated due date is June 20 and gives you an estimated conception date of September 27?

Did the doctor give you that due date from an ultrasound?  If so, how early in the pregnancy was your ultrasound that gave you the June 20 due date?  Is there a possibility it was in your sixth or seventh week?

If not, it is going to be very difficult to know whether you got pregnant from sex on the 23rd or the 28th, since after a while in pregnancy there is a margin for error when using an ultrasound to try to determine conception.  It would be hard enough to split the difference between the 23rd and the 28th without that problem, but if your ultrasound was not until after your first trimester was over, then it could be giving you a date as much as a week off.  So, a lot depends on when the ultrasound was.

Sorry, June 20, not September 27.  In other words, you're saying your due date is June 20 based on what?

Hi, kate, do you mean if you had sex on the 27th, how could it be possible to get pregnant on the 28th?  That's easy, sperm can live up to 5 days inside a woman's reproductive tract (some research says even 6 days or longer).  If a man and woman had sex on a Monday and she didn't ovulate until Tuesday, his sperm would be sitting in her Fallopian tubes waiting for the egg.

How do you know "conception" was on the 27th?
