HIV risk, er visit, 4 different medications

On the early morning of September 3rd 2012 around 1 am I had unprotected sex with someone I later found was HIV +.  I am a gay male and I was on the receptive end during this encounter.  The guy was smaller than average in penis size and he did not last very long (probably 3 minutes).  He pulled out and then ejaculated about 7 seconds after.

Later on I found Atripla in his bathroom and confronted him about it.  He says he was infected 6 years ago and has been Undetectable and a count of 350 for a long time.  He has a partner for about 5 years that is negative and they are sexually active with eachother.

When I found out I went to the hospital and they gave me a HIV test and it came up negative.  They started me on PEP medicine (this is about 4 hours after exposure).  I was given Viread 300mg 1 tablet a day and Combivir 300 mg 1 tablet twice a day.  I took this till Wednesday afternoon to where I went to the HIV Clinic at the hospital.

The doctor changed my medicine to Truvada 200MG-300MG once daily and Kaletra 200MG-50MG 2 tablets twice a day.  I started this medicine on Wednesday night.  I however misread the label and then took only 1 Kaletra instead of the 2.  In the morning of Thursday I took 1 Kaletra.  In the evening of Thursday I realized I misread the label and took 2 Kaletra though I forgot to take the Truvada because I was used to taking the other medicine in the morning (I’ve also not been thinking straight and been very stressed, I made a mistake).  On Friday morning I came to my senses and took 2 Kaletra and 1 Truvada and set a plan so I wouldn’t mess it up and that’s the regiment I will stick too.  I will take the 3 pills every morning with food at 8am then the 2 pills every evening at 6pm for the 1 month period.

I am positive I have no risk from any other person except this one guy who assured me, because he was undetectable for so long, on Atripla and never misses a dose and has a partner of 5 years who is negative and he didn’t ejaculate in me that I am no risk.

I currently do not have any HIV symptoms that were not present pre-exposure and am dealing well with the medicine besides the desire to lay in bed constantly and sleep the day away, but hey I think thats just because I think I have HIV and am depressed.

My question is, what is my risk? I’ve read that undetectable people are almost impossible to transmit sexually.  Also I read about messing up the PEP, did I screw up my chances by taking the medicine at wrong times?

I have pressed charges against him criminally and plan to civilly sue him as well since he told me he was clean and did not plan on telling me he was positive (but legal advice is not why I’m here).

To make matters more interesting I did have a case 1 year ago of very mild genital warts (penile and anal) which are now clear, I was tested and they found HPV because they did a biopsy on one of the warts.  Again that was about a year ago.

Any blunt comments would be appreciated.

I agree, I think it is totally wrong to go after this guy.  Sure, he was wrong, but YOU are the one who took the risk...and only YOU are accountable for your halth and safety.

Continue to have unprotected anal sex with other men, HIV WILL be a reality for you.  It's just CRAZY in this day and age that someone would take that risk.

No you are wrong. I can press charges.  The States Attorneys office picked up the charge.

You had a risk by having unprotected sex. If his viral load is undetectable then yes that is good, but a risk is a risk. 3 months after PEP you can have a test.

You can't press any charges against him or sue him, YOU made the choice to have unprotected sex.
